Social dialogue refers to discussions, consultations, negotiations and joint actions involving organisations representing the two sides of industry, namely employers and workers. The constitutional basis for social dialogue is located within Articles 153–155 of the Treaty on the Functioning of the European Union. In July 2008, a social dialogue committee in European professional football was established. This article assesses the significance of this move and argues that the committee has the long‐term potential to transform industrial relations in European football based on the conclusion of binding collective agreements. In the shorter term, the committee performs two functions: first, as a means of effecting a change in governance standards in European football and as a lobbying technique for the social partners in terms of their relationship with the EU; second, as a venue for a negotiated settlement between the rival interests operating within the EU's sports policy subsystem.  相似文献

Offenders who have committed serious violent acts while incarcerated are often segregated and housed in supermaximum security facilities. Given the highly restricted regime under which they are detained, it is often difficult to decide if they are safe enough to be discharged. However, there is a need to reintegrate them into the general offender population in a lower security institution for humane, correctional, and financial reasons. We propose a transitional strategy to facilitate their reintegration by way of a maximum-security step-down treatment-oriented facility within which both their security requirements and treatment needs could be adequately met. The present study reports the results of such an approach. More than 80% of the offenders (n = 31) were reintegrated into a lower-security facility without relapsing and being returned to the supermaximum institutions within a follow-up period of 20 months. They also have lower institutional offense rate postreintegration compared to prereintegration.  相似文献

The FMLA is a complicated and comprehensive regulatory scheme, and it is impossible to review any but the most basic provisions in this article. The final regulations provide very detailed guidance on such issues as benefits continuation, reinstatement rights, notice requirements, and enforcement measures. Personnel policies and practices must be revised to be consistent with these final regulations, and care must be taken that leave policies do not restrict rights under the FMLA or unintentionally create expanded leave rights. In complying with the FMLA, employers must also keep in mind that there are complex interplays between the federal FMLA, state laws that provide family and medical leave, the Americans with Disabilities Act, and state workers' compensation laws, that can require expert advice depending on the particular circumstances.  相似文献
