ABSTRACT

This essay engages in a dual-disciplinary theorizing of reflexivity as response to crises of democratic representation. We trace this crises through the parallel lenses of democratic theory and art history. As political theorists explore alternative representations of ‘the people,’ contemporary artists have developed their own responses to the crisis of monist representation. In both state institutions and in participatory art – and in the theorizing of both – we find the rejection of monist representations of ‘the people’ and the embracement of pluralist, partial, and proximate representations. These public reflexive spaces give voice to new, partial publics, and call attention to past and present exclusions.  相似文献

在20世纪末,风险已成为占据主要支配力的问题处理方式。对于犯罪学来说,关于风险的争论已经贯穿在研究的全部范畴内。犯罪学中的风险理论经历了从隐性到显性的知识发展。在犯罪控制范式转变中,风险的规制、维控与治理与犯罪的预防、控制与治理分别对应而形成了以回抗、维控、化解风险压力为导向的控制结构。同时,作为犯罪控制结构要素的控制主体、控制措施与控制客体的任一环节的自反性都将使犯罪控制的运行超出设计初衷而出现风险性。犯罪学中的风险理论是犯罪学与风险学科的交叉研究理论,也存在由于风险的不确定性在犯罪治理中的适用所引发的一系列争议性问题。由此,风险议题在解决我国司法实践难题时显得尤为重要。  相似文献

South Asian women are a focus area for organisations such as the UN, World Bank and WHO, where violence against women severely constrains policy instruments such as the Millennium Development Goals. The field researcher is often invisible in research space, which informs policy in practice. Through critical reflexivity we rupture the silence on researcher vulnerability, foregrounding researcher resilience as the ethical compass in the research space of gendered violence. Through narratives of researchers as development actors in the river of corrosiveness involved in acid violence research, we offer a typology for researcher resilience for consideration in research designs for policy development.  相似文献

Contemporary regulators must respond to ever‐increasing societal demands in various domains. Regulators must cope with these demands under conditions of extreme epistemic scarcity and ideological divide. This leaves regulators perplexed about what action they should take. Regulatory praxis offers two primary responses to this moral and epistemic dilemma: technical canonization and reflexive regulation. While these two approaches represent contrary regulatory philosophies, they suffer from two common blind spots: (a) disregard of the critical role of discretionary judgment in regulatory action; and (b) disregard of the dilemma of higher‐order reflexivity. The article explores the idea of higher‐order reflexivity in the regulatory context. This exploration renders visible the abysses that are faced by regulators as they attempt to resolve regulatory dilemmas through a cognizant and introspective process. The article argues that the Socratic concept of courage and the idea of forward‐looking responsibility provide a plausible framework for thinking about the challenge of regulatory judgment. It concludes with a discussion of the legal and institutional mechanisms that could both facilitate and put to scrutiny the realization of this ideal (but noting also several features of the contemporary regulatory system which constitute potential barriers).  相似文献

Abstract

This paper presents a critical comparative reading of Ulrich Beck and Herbert Marcuse. Beck's thesis on ‘selfcritical society’ and the concept of ‘sub-politics’ are evaluated within the framework of Marcusian critical theory. We argue for the continued relevance of Marcuse for the project of emancipatory politics. We recognise that a focus upon the imminent and spontaneous possibilities for radical social change within the ‘sub-political’ is a useful provocation to the high abstractionism of much critical theory, but suggest that such possibilities are better captured in a Marcusian theoretical frame than they are in Beck's account.  相似文献

Abstract

The author inquires into the performative role of calculative devices, and develops the notion of political markets by drawing upon an empirical case of the transfer of flexible manufacturing systems (FMS). Drawing on the work of Michel Callon, the author claims the natural market to be a special case of the political market, its existence being highly dependent upon calculative devices. The aggregated simulation models and investment calculations of economics were instrumental in establishing the necessary conditions of the natural market. Yet, it remained only a temporally stabilized configuration. With the emergence of reflexive economic agencies, the market also underwent unexpected reorganizations. Finally, the author summarizes the theoretical and practical implications by proposing the twin notions of engineering-oeconomicus and the normalizing market residual.  相似文献

This article frames whistleblowers as regulatory intermediaries who provide a response to the problem posed by the fragmentation of knowledge in a complex society and market economy. I identify two ways in which whistleblowers become regulatory intermediaries: The first is by remedying informational asymmetries between the regulator and the target (instrumental approach). Both in the United States and in the European Union, whistleblowers are protected on the basis of the value of the disclosed information for the advancement of regulatory objectives. The second way in which whistleblowers become regulatory intermediaries is by contributing to the development of “communities of compliance” and by enhancing the internal self-regulatory capacities of regulatory targets (reflexive approach). Creating internal channels of reporting and monitoring is perceived as a way to change the organizational culture of targets. Through the instrumentalism – reflexivity dipole, competing rationales and normative visions of regulatory intermediation become apparent: It could, on the one hand, facilitate state intervention and legal sanctions or, on the other hand, signal the aspiration to embed public and social values in private actors.  相似文献

In this article, I describe a reflexive approach to mediation, which I see as a promising corrective to two positivist ideas in our field that are slow to fade: that we should be neutral as third parties and that parties should seek solutions based on objective truth. Grounded in a more constructionist approach using findings from qualitative social research and drawing analogies from those findings as they apply to mediation, a reflexive praxis accepts the reality that a third party cannot be neutral and that constructive outcomes to conflicts are rarely rooted just in “the facts.” Rather this view holds that an intersubjective rendering of reality in and out of the mediation room constitutes a large part of the collaborative effort of mediation.  相似文献

This is a critical personal narrative of a Canadian Middle-Eastern Muslim female Shi’i educator’s experiences in a Western academy. The different cultural and religious backgrounds that shape a Muslim woman’s academic work and her understanding of social justice are described. Specifically, the author describes religio-historical figures and the counter-narratives of women of color in the author’s life responsible for shaping her appreciation of the importance of engaging in social justice and equity. The subjectivity in this work is manifested as an alignment with her religious beliefs and doctrine that draws from a counter-narrative (i.e. the Shi’i narrative of Karbala and, more broadly, the marginalized and dissenting ideological position of Shi’ is in relation to global Islam). Her upbringing with and introduction to Shi’i rituals, empower her understanding towards issues related to justice, equal rights, and loyalty. Throughout her narrative, the author utilizes the role of a researcher as an insider and outsider based on religious and feminist approaches. Three significant themes are noted: (a) the critical role of spirituality as a powerful catalyst and feminist for transformative change; (b) the role of reflexive skills and self-criticism as a means to balance religious and academic identities; and (c) the import role of ‘border-crossers’ in negotiating and connecting between religious and academic worlds. Insights about the experiences associated with minority Shi’i Muslim female graduate educators and the importance of being critically reflective when working towards social justice and equity are provided.  相似文献
