当今社会,社会矛盾呈现出复杂化、多样化的特点,替代性纠纷解决机制(ADR)作为一种在世界范围内被广泛应用的新型纠纷解决机制,不仅有效地缓解了司法机关的诉讼压力,也促进了各国多元化纠纷解决机制的合理构建及有效运行。而调解作为现代ADR的主要形式,它的广泛应用,尤其是美国法院附设ADR调解的成功应用经验,对我国调解制度特别是法院调解的改革具有深远的借鉴意义。

Exploring the Road of Reforming Chinese Court Mediation in Light of the United States Court-Annexed ADR Mediation System

In today＇ s society, social contradictions present complicated and diverse characteristics. ADR （ Alternative Dispute Resolution） , as a range of widely used new dispute resolution mechanism, not only allevi- ates the judicial organs＇ pressure, but also promotes the diversified dispute resolution mechanism of construc- ting reasonable and effective operation. The widely application of Mediation as the main form of modern ADR, especially the experience of the successful application of ADR in United States court mediation, has profound significance for the reformation of our court mediation. The article introduces the author＇ s experiences about the American ADR mediation system in the training of ADR, especially with the court mediation program, and explores the mediation system behind the adjustment cultural differences, probes into the reform of the system of direction in mediation.
