| 摘 要： | 我国现行破产法只适用于企业法人破产的规定 ,已不足以解决我国实践中大量债务不能清偿的问题 ,在设计灵活多样的程序制度的同时 ,新的破产法应当适用于自然人和企业法人。

| Abstract: | The provisions of the existing bankruptcy law of China which are only applicable to business entities,cannot resolve the great amount of problems with respect to discharge of debts in practice.While the procedure systems are designed to be flexible and diverse, the new bankruptcy law should applicable to both natural persons and business entities. |
