When children are involved in the murder of one parent by the other, their lives are turned-upside down. They are immediately confronted with police and court interventions and by child welfare decisions. This article looks at the policy of the Dutch Child Protection Board in such cases. We consider the legal arrangements made by the Board for dealing with the child's future residence and any special needs. We also consider the ways in which social workers from the Board depict the families of uxoricide and perceive the future relationship of the child with the surviving parent.  相似文献

对于美国城市规划判例中的著名案件"劳雷尔山Ⅰ案"判决的解读,可以分析得出:城市规划中"公共福祉"的判断不应仅限于规划所辖地域范围内的利益考虑,还应考虑受规划影响的地域和人群;人的基本住房需求是"公共福祉"的绝对要素,当公共福祉的各要素间冲突时,要素的重要性以及手段和目标之间的不可替代性成为在具体情况下公共福祉判断的关键;"公共福祉"实现需要私人和公共行为共同作用。以上结论对于我国城乡规划制定中应考虑的利益范围的确定及其考量因素冲突的选择,提供了启示。  相似文献

"国利民福"是民元至民二上半年这一特定历史时段的词汇,笼统地指近代民族国家的经济利益和人民的福利、幸福。它是孙中山对在清帝逊位后准备实行的民生主义的一种理论预期,也是他在分析实行民生主义的效果时提出来的一个概念。它既是革命党人的出发点和应有的情怀,又是革命党人追求的最终目标,甚至被上升为革命政党的主义或党德的高度,孙中山因此将他所从事的民主革命称为"国利民福革命"。由于"国利民福"中的"国"特指近代民族国家,即孙中山心目中真正的中华民国,当中华民国名存实亡时,"国利民福"就很少出现在孙中山的各类文本中。  相似文献

有相当的国有财产是为公务便利或社会公益服务而存在的 ,国家作为行政主体行使行政权时在该财产上享有的物权不同于民法上的物权 ,不以盈利为目的 ,不应受一般私法规则的支配 ,而应受公法规则的支配。存在于该财产之上的物权便是行政法上的物权。法国行政法将公众用物和行政活动用物作为不同于私有财产的“公产” ,这一划分在现代国家体系及市场经济背景下有重要意义。借鉴相关理论 ,建立、健全我国行政法上的物权理论 ,将对我国行政法理论和实践大有裨益  相似文献

构建全体成员各尽其能、各得其所而又和谐相处的社会已经成为未来的奋斗目标,而衡量标准之一就是社会总体福利和成员个体福利的同步增长。历史经验和理论研究已经证明,增进福利的重要使命不能由国家独自承担,多元化的福利供给是构建和谐社会的重要内容。企业是社会主义市场经济的活动主体,也应当和能够参与福利供给,内容之一就是职工集体福利。我国旧的职工福利制度是计划经济和国家福利的产物,必须在理论反思基础上,就职工集体福利的资金筹集、管理机构和供给方式等方面予以制度重构。  相似文献

Recent scholarship on the populist radical right tends to imprecisely describe the welfare agenda of this party family with reference to its key ideological characteristics of nativism, authoritarianism, and populism. We propose an alternative analytical framework that considers the multidimensionality of welfare state positions and the “deservingness criteria” that underlie ideas about welfare entitlement. Applying this framework to a sample of four European populist radical right parties, we conclude that three interrelated frames inform their welfare agenda. These parties, we argue, advocate social closure not only on the basis of the deservingness criterion of identity (welfare chauvinism), but also on criteria of control, attitude, and reciprocity (welfare producerism) and on an antagonism between the people and the establishment (welfare populism). Understanding the welfare agenda of the populist radical right requires us to move beyond welfare chauvinism and to reconsider the concept of welfare producerism and its interaction with welfare chauvinism.  相似文献

行政法中公私协力问题在德国、日本以及我国台湾地区等地都有相当大的发展和相当精深的研究。当前公私协力行为在我国大陆行政实践中也广泛存在,然而我国大陆行政法学者的关注却很不够,理论研究严重滞后于现实发展的需要。从实现给付行政的国家任务入手,可以从宏观上把握公私协力所处的时代背景和所秉持的行政法理念。公私协力中的行为形式选择既是重要的理论问题,也是实践中无法回避的问题。公私协力行为也对传统行政法学构成巨大的挑战,理应获得足够的重视。  相似文献

Based on a combination of administrative data; juvenile court record review; and informed‐participant interviews of juvenile court judges, attorneys, and service providers, the current study examines the impact of the Foster Children's Project (FCP). FCP is a program that provides professional legal representation to children in substitute care. Legal representation by FCP attorneys is found to increase the rate of children's exit to adoption, leading to a higher overall rate of exit to permanence. The rate of exit to reunification is not, however, found to be affected by FCP representation. Implications for juvenile court policy and practice are discussed.

Voters with lower socio-economic status are now consistently overrepresented among the radical right electorate. According to the ‘new winning formula’, many radical right parties increasingly move to the left on socio-economic issues to cater to these voters. This study tests a crucial assumption underlying this formula: whether radical right parties with socio-economically left-leaning positions actually attract more working class voters. By mapping class characteristics of the electorate of 10 radical right parties at three time points (based on surveys) against these parties' positions on the economic dimension (according to experts), this study shows that the ‘class gap’ - the extent to which class indicators predict voters' propensity to vote for the radical right - is significantly larger for socio-economically leftwing parties.  相似文献
