辩诉交易之我见

我国刑事诉讼法律中虽然没有设立辩诉交易制度,但在一些刑事法律制度及刑事政策中都蕴含着辩诉交易的精神。司法改革客观上要求强化辩诉交易的运用。在改革我国刑事诉讼程序的同时,可以分步设立有中国特色的辩诉交易制度,以促进司法效率与司法公正的有机互动和协调发展,提高刑事诉讼的司法效能。     

辩诉交易本土化的可行性

辩诉交易在不同法系国家被重视并合法化,但辩诉交易的引进潜藏着巨大的风险,如以钱买刑,击溃我国司法宽容的底线,严重损害刑事被害人的权益保护等。在当下我国,对于辩诉交易需要少一些实用主义、多一些理性分析,坚持刑事司法的基本原则,恪守刑事司法的底线,避免制度过于宽松造成司法不公。     

浅析“刑事和解”制度

刑事和解"作为一种新型的刑事诉讼纠纷解决机制,它是应时代的发展产生的较为人性化、注重人道主义、适度宽松灵活、诉讼成本低廉的现代纠纷解决制度。它不同于"辩诉交易""恢复性司法"等相近的制度,是社会转型时期新型矛盾层出不穷时的一种制度。它在带给轻微刑事案件更加便捷处理方式的同时,也可能因为没有立法对此制度的规定,侵害着其他的法益。本文就针对此制度在实践中的适用及使用过程中呈现出的弊端提出相应的完善建议,以期为制度改革完善提供参考。     

辩诉交易之理论意义及可行性分析

辩诉交易是英美法中的一个概念,产生并存在于特定的法律文化中。虽然目前大陆法系的一些国家也着力借鉴,但均会因本国国情而加以改造。辩诉交易在其发源的国家一直有存废的争议。我国理论界讨论的协商性刑事司法（刑事和解）与辩诉交易存在着本质区别。认真分析辩诉交易制度,有助于更好地理解并设计出符合我国国情的相关制度。     

辩诉交易启示与对我国刑事基本政策的反思

美国和意大利的辩诉交易制度带给我们以下新的启示 :①辩诉交易在刑事诉讼中创生了一种非对抗性的案件处理机制。②辩诉交易使刑事诉讼中出现了控辩双方互利双赢的局面。③辩诉交易对于处理疑罪提供了一种新的选择方式。我国“坦白从宽 ,抗拒从严”的基本刑事政策其内在精神与辩诉交易制度相通 ,但由于缺乏法律化、制度化的规定及完备的程序保障机制 ,影响了其实效的发挥。刑事处罚与认罪交易制度的建立有利于充分彰显其价值     

关于辩诉交易程序的理性思考

辩诉交易是指被告人作出认罪答辩,公诉人则作出撤销部分指控、降格指控或者建议法官从轻判刑的承诺,被告人和控辩方通过协商达成协议的刑事司法制度。辩诉交易产生于美国,由于其具有传统案件审理方式所不具有的很多优点,被许多国家借鉴、改造,以不同形式运用于司法实践中。我国借鉴辩诉交易具有重要意义,在我国的司法实践中尝试辩诉交易是可行的。     

初探辩诉交易制度的引入和改造

辨诉交易制度是一项起源于美国的刑事司法制度,目前已被西方国家广泛采用.我国是否可以将这项司法制度作为他山之玉加以引入,理论界和司法实务界存在较大争议.从辩诉交易制度包含的公正和效率的辨证关系分析,在我国引入该制度有一定的必要性.我国对辩诉交易制度的移植不能全盘引入,而应当是取其精华进行借鉴,使之本土化,对不足部分采取必要措施加以防止.
