国外和我国港台地区"社区矫正"法律规范的殷鉴

今年7月,最高人民法院、最高人民检察院、国家公安部、国家司法部在“关于开展社区矫正试点工作的通知”中指出:“在试点工作取得经验基础上,促进有关社区矫正方面的立法工作,为改革和完善中国特色的刑罚执行制度提供法律保障。”而国外和我国港台地区社区矫正立法的成功经验,可以给我们社区矫正的立法以有益的借鉴。

社区矫正是西方国家盛行的以社区为基础并通过社区矫正罪犯的制度.经过19世纪、20世纪的创建与发展,该制度已成为一项稳定的行刑制度,其中以美国最为典型.21世纪初,我国部分省市推出了试行社区矫正的行刑改革之举,这是我国行刑领域与世界接轨的务实之举.就世界范围而言,社区矫正是以对监狱行刑的理性审视、执著于行刑人道主义、讲求行刑成本效益为崛起原因,以对犯罪的非监禁方式反应形式、减少冲突成份、强调人伦责任为特点,以法院判决的指导原则、犯罪人的选择、有效的措施为机制成分.实际上,我国社区矫正的试点工作仅仅是在解决1983年监狱工作划归司法部的历史遗留问题,属于社区矫正工作的初级程度.我国的社区矫正工作任重道远,须从立法上从长计议,才符合建设"法治国家"方略的要求.

有中国特色社区服务刑制度探究

“社区服务刑”作为社区矫正的最基本方式已被当今世界许多国家立法予以认可并加以执行。我国应借鉴国外社区服务刑的立法和实践,充分认识我国刑罚体系中增设社区服务刑的必要性,注重结合我国社区矫正试点工作的实践,探索社区服务刑的适用对象、判决和执行的基本制度,积极创建有中国特色的社区服务刑制度体系。     

我国社区矫正制度探析

社区矫正是与监禁矫正相对的行刑方式．已成为世界各国广为采用的一项行刑制度，推行社区矫正制度具有重要的意义。由于我国社区矫正工作尚处于试点阶段，还存在明显的缺陷。我国应通过完善社区矫正法律制度．加强社区矫正的队伍建设，扩大社区矫正范围,创造矫正对象再社会化良好环境等措施来改革和完善我国社区矫正制度。     

我国社区矫正实施中的问题及对策

社区矫正是与监禁矫正相对的行刑方式,其在我国试点实施已近5年,但实施过程中的某些问题严重制约着社区矫正制度的发展.目前,构建我国社区矫正制度发展的长效机制必须要解决的问题包括:完善社区矫正立法;统一刑罚执行权;加快社区和非政府组织的培育,加强民众社会责任感;加强对司法所的人、财、物保障以及强化农村社区矫正力量等.     

我国社区矫正制度的价值分析与完善

社区矫正是与监禁矫正相对的行刑方式，已成为世界各国广为采用的一项行刑制度，推行社区矫正制度具有重要的意义。但是与西方国家相比，我国社区矫正工作尚处于试点阶段，还存在明显的缺失。我国应通过更新刑罚观念，建立健全专门的社区矫正机构辛口人员，明确适用社区矫正对象的范围和条件，对矫正对象进行分类分层次管理，为矫正对象再社会化创造良好的环境等措施来改革和完善我国社区矫正制度。

我区为全国社区矫正试点工作省区之一。自治区决定在包头、鄂尔多斯、通辽市和兴安盟开展社区矫正试点工作,为此,自治区党委办公厅、政府办公厅转发了自治区高级人民法院等13部门《关于开展社区矫正试点工作的意见》。     

我国青少年犯罪社区矮正存在的问题与不足

我国从2003年7月起开展社区矫正试点工作，虽然社区矫正试点工作取得了良好的法律效果和社会效果，但仍存在较大的法律障碍和其他方面的不足。笔者主要从八个方面论述了我国青少年犯罪社区矫正存在的问题与不足，旨在对社区矫正的立法完善有所帮助。
