浅论法律援助的“社会需求”

司法部关于法律援助事业“十一五”时期发展规划将逐步扩大法律援助覆盖面，保证符合规定的困难公民都能获得必要的法律援助作为“十一五”时期法律援助事业发展的一个主要目标，完全顺应了党的十七大提出的关注民生、促进社会和谐，实现社会各项事业协调发展的基本要求，是当前和今后一段时间全国法律援助工作必须努力实现的一个重要战略任务。     

Determination and validation of tetrodotoxin in human whole blood using hydrophilic interaction liquid chromatography-tandem mass spectroscopy and its application

A sensitive analytical method was developed for the quantitative determination of tetrodotoxin (TTX), a powerful sodium channel blocker, in human postmortem whole blood. The sample mixture was cleaned up using cation exchange SPE catridge after protein precipitation by methanol and then separated on a PC-HILIC (phosphorylcholine hydrophilic interaction liquid chromatography) column (150 mm × 2.0mm i.d., 5 μm) using a isocratic elution of 1% acetic acid and acetonitrile. The identification of TTX was performed on tandem mass spectrometry with electrospray ionization interface in positive ion mode. The retention time of voglibose (internal standard) and TTX was 5.1 and 6.0 min, respectively. TTX and internal standard (voglibose) were monitored and quantitated using the ion transitions: the respective precursor to product ion combinations, m/z 320/302 for TTX and m/z 268/92 for voglibose in the multiple reaction monitoring (MRM) mode. The recovery of TTX and voglibose was 61.4% and 62.8%, respectively and the good accuracy (97.7-103.9%), linearity (2-1200 ng/mL) and reproducibility were shown in this method. The limit of detection and limit of quantification were 0.32 ng/mL and 1.08 ng/mL, respectively. This method was applied in the case of three fishermen who were poisoned (including one death) by unknown fish on their boat in October 2010. In this case, the levels of TTX were 27.2, 30.0 and 29.7 ng/mL in heart blood, peripheral blood and serum of a victim, were 3.1 and 12.1 ng/mL in peripheral blood and 3.9 and 12.8 ng/mL in serum of two survivors, respectively.     

On the Yogic Path to Enlightenment in Later Yogācāra

In later Yogācāra, the path to enlightenment is the course of learning the Four Noble Truths, investigating their meaning, and realizing them directly and experientially through meditative practice (bhāvanā). The object of the yogi’s enlightenment-realization is dharma and dharmin: The dharma is the true nature of real things, e.g., momentariness, while the dharmin is real things i.e., momentary things. During the practice of meditation, dharma is directly grasped in the process of clear manifestation (vi?adābhā) and the particular dharmin is indirectly ascertained in the process of determination (adhyavasāya). So, even though a yogi does not directly perceive any actual thing, s/he is still nonetheless able to undertake practical activity directed toward it. The realization of the Four Noble Truths consists of two aspects: firstly, the manifestation of momentariness, etc., in the stream of the yogi’s consciousness; secondly, the ascertainment of momentariness, etc., in whatever s/he happens to encounter.     

Why Japan and Russia have failed to solve the territorial dispute: the 1956 Joint Declaration and the mechanism of political coherence

Despite the several chances of agreement, Japan and Russia have failed to solve the dispute over the Northern Territories/South Kuril Islands. The 1956 model seems to be the most plausible method, but the lack of political coherence of the central politics and the will of negotiation became the factors that hinder the two countries from reaching an agreement. By reviewing the conflicting footprints and strategies of the two countries, the authors argue that the more democratized and diffused a political system is, the more difficult it is to come to an agreement in negotiations. This intensifies the existing theory of foreign policy decision-making process emphasizing the influence of domestic constituents.     

Evaluation of Mastoid Process as Sex Indicator in Modern White Americans using Geometric Morphometrics

Conventional methods for evaluating the mastoid as a sex indicator cannot determine whether mastoid shape is an independent and reliable sex indicator. Here, shape differences between the mastoids of 100 male and 100 female modern white Americans were statistically analyzed and visualized using the geometric morphometric method. Discriminant analysis was performed on mastoid size and shape. The relation between size and shape was analyzed to examine the effect of size on shape. In the results, mastoid size and shape were statistically significant sex indicators, while size factor explained 87.3% of the total variance of the shape variables. Nevertheless, females had relatively broader and shorter mastoid shape than males regardless of size, reflecting 12.7% of the total variance of the shape variables. In conclusion, mastoid size and shape were statistically significant sex indicators, while size may matter more in the mastoid than in other cranial parts in terms of sexual dimorphism.

Structural Change in U.S. Presidents' Use of Force

Has there been a structural change in the way U.S. presidents use force abroad since the nineteenth century? In this article, I investigate historical changes in the use of force by U.S. presidents using Bayesian changepoint analysis. In doing so, I present an integrated Bayesian approach for analyzing changepoint problems in a Poisson regression model. To find the nature of the breaks, I estimate parameters of the Poisson regression changepoint model using Chib's (1998) hidden Markov model algorithm and Frühwirth‐Schnatter and Wagner's (2006) data augmentation method. Then, I utilize transdimensional Markov chain Monte Carlo methods to detect the number of breaks. Analyzing yearly use of force data from 1890 to 1995, I find that, controlling for the effects of the Great Depression and the two world wars, the relationship between domestic conditions and the frequency of the use of force abroad fundamentally shifted in the 1940s.     

Does price really converge among provinces in Canada？ A study using unit root tests for cross-sectional panels

This paper examines price convergences across different provinces in Canada using 1983-2006 data. We adopt the new panel unit root tests for analysis that can correct for cross-sectional correlation. Our findings are contrary to previous studies and we conclude that intra-national price convergence does not occur. We also briefly discuss the reasons for the absence of convergence within Canada.     

Determinants of citizen support for community-oriented policing

The extent to which community members are willing to cooperate with the police and become involved with various community crime prevention programs depends on citizen perceptions of the police and of the community in which they reside. The purpose of the present study is to explore factors that affect support for community policing in a small rural city. Findings revealed that the majority of respondents supported community policing. Using community survey data collected from over 400 citizens in a small metropolitan area in the intermountain West, this study also explored the importance of demographic factors, community characteristics, and public perceptions and experiences with police in predicting citizens’ support for community policing. Citizen support for community-oriented policing varied somewhat by demographic factors (i.e., gender, education), and by community characteristics (i.e., disorder, social cohesion).
