A human rights-based practice framework for sexual offenders

Abstract

Human rights create a protective zone around people and allow them the opportunity to further their own valued personal projects without interference from others. In our view, the emphasis on community rights and protection may, paradoxically, reduce the effectiveness of sex offender rehabilitation by ignoring or failing to ensure that offenders’ core human interests are met. In this paper we consider how rights-based values and ideas can be integrated into therapeutic work with sex offenders in a way that safeguards the interests of offenders and the community. To this end we develop a rights-based normative framework (the Offender Practice Framework: OPF) that is orientated around the three strands of justice and accountability, offender needs and risk, and the utilization of empirically supported interventions and strength-based approaches. We examine the utility of this framework for the different phases of sex offender practice.

我国地方政府创新活动在学术界、媒体和公众的共同推动下,呈现出日益蓬勃的发展态势。地方政府创新的实质是公共治理创新,目的是提高公共服务质量和政府自身的管理能力。目前,地方政府创新存在的主要问题是创新动力不足、创新环境不佳和创新成本较高。文章从国家制度建设、地方政府的层级节制和社会评价机制建设方面对促进与规范地方政府的创新行为进行了思考。

法人精神损害赔偿当取决于民法原则、目的和司法问题之解决,而不仅由单纯的一般概念和法学概念推导决定。民法理论上,民事主体拟制属性和民法公平原则与目的均支持法人精神损害赔偿;司法实践中,填平补偿法人非财产损害,对法人非财产损害引起的大规模自然人精神损害的补偿都急需法人精神损害赔偿之确定。     

Driving South: The globalization of auto consumption and its social organization of space

ABSTRACT

Don Mitchell is one of the most influential contemporary cultural geographers and has long been at the forefront of scholarship on intersections of capital, nature and labor. His work engages the geo-historical processes of landscape co-production and discusses how social, political and labor struggles that formed landscapes have been hidden or erased. Mitchell’s research and work are informed by an urgency to uncover the forces shaping the human–land dialectic. It is difficult not to sense profound urgency at the current political–ecological conjuncture, which is why we turned to Don Mitchell to reflect on his research, intellectual practice and the state of academia and activism today. The first section of the interview centers on Mitchell’s research and the tools and methods he employs in his work. In the second section of the interview, we discuss strategies and tactics in resistance struggles, campus activism and radical scholarship. Infused throughout the interview are the influences that have shaped Mitchell’s unique approach to teaching, research and a critical academic life. We conclude with a section on current academic practice.     

eGovernment

Abstract

This article gives an overview of policies and progress on eGovernment in Europe. Propelled by the implementation of the eEurope 2002 Action Plan, collaborative R&D work and the establishment of trans-European telematic networks between EU national administrations, eGovernment applications have developed dramatically in Europe. However, the first achievements will not fulfil their promises if further challenges are not addressed by the decision makers at all levels of government. Top-level leadership and commitment is necessary to deepen eGovernment, not least for the change management needed for reorganisation of government back offices. The transfer of eBusiness practices into the public sector can help to achieve increased productivity and inclusion, by ensuring access for all to government eServices. The Brussels eGovernment Conference in November 2001 highlighted both the quality of existing eGovernment applications and the potential of European cooperation. European administrations are setting new standards as a basis for further progress.
