从融合到分立:儿童网络色情信息犯罪的刑事规制

儿童网络色情信息犯罪侵害的法益是"直接层法益"与"间接层法益"双重法益。"直接层法益"为儿童的身心健康权利与以"免受性剥削和性虐待"为核心的被动性的性权利,"直接层法益"为个人法益;"间接层法益"为性道德等社会法益。而成年人网络色情信息犯罪侵害的主要是基于"性的隐秘性"善良性风尚和性道德的社会法益。法益具有立法检视功能和区分功能,客观上需要将儿童网络色情犯罪与成年人网络色情犯罪分离,进而设置独立的刑事规范,并对儿童网络色情信息范围、犯罪行为类型及网络服务提供商的责任重新进行建构。     

Chinese Eastern Industrial Zone in Ethiopia: unpacking the enclave

Abstract

This paper examines China’s engagement with Africa through economic zones (EZs). It moves beyond the conceptualisation of EZs as undifferentiated enclaves of foreign investment to a dynamic perspective on the locally negotiated process of zone development. Such a perspective entails critical unpacking of the specific zone regime to understand the diverse and evolving relationships among different state and non-state actors. Drawing upon empirical research on the Eastern Industrial Zone (EIZ) in Ethiopia, we explore the complex process of learning and adaptation by government, developers, investors, and workers throughout the development of a zone regime, with specific attention to capital–labour and expatriate–local relations. We find that despite the EIZ being a state-level cooperation project, private Chinese developers work diligently with the Ethiopian government to improve the institutional support for EZs. Chinese investors also collectively generate a management regime to enhance their overseas operational capacity and experiment with various tactics to transform local recruits into an industrial workforce. Local workers, with limited protection by official labour unions, turn to individual- and group-based agency to improve their working conditions. Despite the momentum created by multiple stakeholders, there are concerns regarding the long-term contributions of EZs to engender sustained industrial transformation and skills development.

Portable high‐resolution automated 3D imaging for footwear and tire impression capture

The forensic science community raised the need for improved evidence recognition, collection, and visualization analytical instrumentation for field and laboratory use. While the 3D optical techniques for imaging static objects have been extensively studied, there is still a major gap between current knowledge and collecting high‐quality footwear and tire impression evidence. Among optical means for 3D imaging, digital fringe projection (DFP) techniques reconstruct 3D shape from phase information, achieving camera‐pixel spatial resolution. This paper presents a high‐resolution 3D imaging technology using DFP techniques dedicated to footwear and tire impression capture. We developed fully automated software algorithms and a graphical user interface (GUI) that allow anyone without training to operate for high‐quality 3D data capture. We performed accuracy evaluations and comparisons comparing with the commercial high‐end 3D scanner and carried out qualitative tests for various impressions comparing with the current practices. Overall, our technology achieves similar levels of accuracy and resolution with a high‐end commercially available 3D scanner, while having the merits of being (1) more affordable; (2) much easier to operate; and (3) more robust. Compared with the current practice of casting, our technology demonstrates its superiority because it (1) is non‐destructive; (2) collects more evidence detail than casts, especially when an impression is fragile; (3) requires less time and money to collect each piece of evidence; and (4) results in a digital file that can easily be shared with other examiners.     

明治维新与近代日本乡村国民意识的形成

明治维新促成近代日本国民国家的形成,国民意识作为建构现代民族国家的重要一环,对稳定日本国内政治环境、创造有益于推行改革的社会氛围发挥了重要作用。从江户末期到明治中前期的改革与维新中,在义务教育、征兵制、地税改革等国家权力自上而下渗透的政策中,国民意识被强制灌输给乡村民众,取代原有的乡土认同,国家认同得以强化;其引发的不适作为社会问题浮现出来,又自下而上地反作用于改革,带来国民与国家之间的互动,国民意识中的国民主体性得以彰显,丰富了国民意识的内涵。在二者的磨合与互动中,到1889年明治维新结束时,国民意识在近代日本乡村初成。     

The Closeness Problem and the Doctrine of Double Effect: A Way Forward

A major challenge to the Doctrine of Double Effect (DDE) is the concern that an agent’s intention can be identified in such a fine-grained way as to eliminate an intention to harm from a putative example of an intended harm, and yet, the resulting case appears to be a case of impermissibility. This is the so-called “closeness problem.” Many people believe that one can address the closeness problem by adopting Warren Quinn’s version of the DDE, call it DDE*, which distinguishes between harmful direct agency and harmful indirect agency. In this paper, I first argue that Quinn’s DDE* is just as vulnerable to the closeness problem as the DDE is. Second, some might think that what we should therefore do is give up on intentions altogether and move towards some kind of non-state-of-mind, victim-based deontology. I shall argue against this move and explain why intentions are indispensable to an adequate nonconsequentialist theory. Finally, I shall propose a new way of answering the closeness problem.

玻璃碎片及形态是案发现场常见的物证形式,开展对玻璃的物证分析研究,能够确定玻璃的来源与种类,推断玻璃破碎原因等,为案件的取证、重建和侦破提供线索和证据。简要介绍了常见玻璃的种类,分析了玻璃破碎的根本原因,总结了低速冲击和高速冲击下玻璃破碎的形态特征,还从玻璃碎片收集和检验两个方面探讨了玻璃实体物证的分析。     

协商民主理论视野下和谐民族关系的构建

独具中国特色的协商民主制度为我国构建和谐民族关系奠定了基础。协商民主能够在实现各民族有序参与自治权利、利益平衡、增强政治认同方面,在促进各民族文化共存、包容差异、处理民族宗教事务方面发挥重要作用。构建和谐的民族关系,应注重发挥政协和基层的协商民主作用,注重发挥网络协商平台的作用。     

印尼华人与2014 年印尼大选

1998年以来印尼华人积极参政，至今已成为印尼政治发展的一股重要力量。2014年印尼大选，华人选民受到印尼主要政党的高度重视，不仅纷纷派出华人候选人，个别政党还邀请华人搭档竞选总统副总统。华人积极参与国会选举，成绩显著，广大华人选民倾力支持的佐科维成功当选总统，凸显了华人选票的影响力。在印尼不断推进政治民主和族群和谐的大环境中，印尼华人参政的良好势头，将持续发展。     

浅论大学生网络思想政治教育的现状及对策

目前,网络己进入到现实社会中的各个领域,对当代大学生的观念和认知产生了深刻的影响,同时也给思想政治教育工作带来了严峻的挑战。本文试图从网络思想政治教育的概念及其特征出发,在总结目前大学生网络思想政治教育存在问题的基础上,进而提出加强大学生网络思想治教育的对策。
