新中国成立初期,中国共产党带领人民实现了从民族危难到民族独立的转变,并朝着民族复兴的目标阔步向前。在此阶段,我党始终坚守政治性这一根本属性,重视政治建设,于摸索中前进,于前进中总结。在推进新民主主义向社会主义过渡,并建设社会主义的过程中,中国共产党守正创新,领导中国人民逐步建立完善的政治制度体系;解放思想,正确看待社会主义矛盾问题;以人为本,巩固发展社会主义民主与法制;实事求是,坚持确立党和国家的领导制度。     

马克思对黑格尔法哲学的三维批判——对《黑格尔法哲学批判》的解读

马克思对黑格尔法哲学三个维度的批判都超出了政治哲学的范围,具有更广泛的一般哲学意义。第一,批判黑格尔法哲学唯心主义世界观,马克思指出头足倒置既是黑格尔法哲学的特征,也是黑格尔全部哲学的特征,进而确立市民社会决定国家的历史唯物主义观点;第二,批判黑格尔法哲学"发展逻辑",揭示黑格尔辩证法的泛逻辑主义方法的缺陷,马克思走向"在事物自身的发展中揭示事物发展的逻辑"的唯物辩证法的哲学道路;第三,对黑格尔法哲学的自由观的批判,得出自由的实现必须通过无产阶级革命创建新国家的结论,马克思完成了政治立场的转变,为自己确立了创立无产阶级哲学的历史使命。对黑格尔法哲学的批判表明马克思的哲学从世界观、方法论、历史观上都已不同于黑格尔思辨、抽象的唯心主义,也显示出其在实践性、阶级性和革命性上与黑格尔哲学具有根本的区别。《黑格尔法哲学批判》在马克思主义哲学发展史上的重要地位就是使"马克思成为马克思"。     

服务型社会救助:西宁的实践与优化

一、问题的提出2020年脱贫攻坚战的完美收官,表明我国已全面消除绝对贫困,进入相对贫困的阶段。这意味着人民生活水平大幅提升,人民的幸福感、获得感、安全感得到了极大的提升。而在社会救助领域中,原先的物质型救助方式已不适用于新时期、新情况、新问题解决的要求。     

数字政府建设下政企合作责任承担机制研究

政企合作是数字政府建设的重要保障,清晰的责任承担机制则是发挥政企合作优势与化解合作风险的关键。考察数字政府建设的实践,政企合作责任承担机制存在主体多元、法律工具多元与利益多元的冲突,进而出现外部责任推诿与内部责任模糊的突出困境。回归责任关系本身,国家担保理论可为数字政府建设下政企合作提供外部形式责任承担的合理范式;密切性和控制性标准确立的事先风险责任,归责原则划定的事后损害责任,则为内部实质责任的承担开辟有效渠道。在实现路径上,数字政府建设应当明晰政企合作的权利义务关系,确立整体政府理念下内外责任的承担机制,促进政企合作的高效运作与可持续发展。     

Diffusion models over the life cycle of an innovation: A bottom-up and top-down synthesis approach

The diffusion models tend to be tested individually in isolation and remain the same over time for the studied innovations in the literature. Moreover, there is growing interest to learn from other countries in our current age of globalization. Therefore, this paper chooses the innovation of public resources trading platforms in China to fulfill above literature gaps. We have examined key events and the issuances of related laws and regulations by Chinese governments. Our contributions are twofold: (a) Our analysis and results show that the diffusion models evolve over the different stages of a life cycle of an innovation, contrasting to the literature results that diffusion models remain the same for their studied innovations. Due to major diverse characteristics among different adopter categories over a life cycle of an innovation, we argue that it is appropriate and necessary to apply different diffusion models on different adopter categories, which is missing in the current literature. (b) We find a first bottom-up and then top-down synthesis approach as an effective, efficient diffusion process for both fitting local needs (i.e., effective) and adopting innovations rapidly nationwide (i.e., efficient).     

“短视频热”影响下的青少年价值观教育及其建构

近年来,短视频APP的井喷式增长使其迅速成为社交媒体的新宠,短视频信息传播的快速化、参与主体的全民化、传播内容的个性化、输出信息的多元化使其迅速成为青少年娱乐社交的重要组成部分,同时它也满足了青少年释放和表达自我的要求、自由平等的诉求、关注认可的渴求、求新求异的追求。因此"短视频热"深刻影响着青少年的人生价值观、道德价值观、审美价值观和交往价值观。为消解"短视频热"对青少年价值观教育的消极影响,学校应对师生进行媒介素养教育,利用短视频提升价值观教育的实效性;家长要培育交往价值观,指导和约束并举;青少年自身应增强审美能力,树立道德自觉意识;短视频平台的内容应做到雅俗共赏,用价值观引领算法机制。     

Corporate policy entrepreneurship and cross-boundary strategies: How a private corporation champions mobile healthcare payment innovation in China?

The private nature of corporate actors does not necessarily preclude them from contributing to public interest. When business strategies and genuine public motivation are favorably aligned, corporate actors from the private sector can also drive public sector innovations. For a private corporation, policy entrepreneurship inherently entails crossing not only the public–private boundary but also various policy domains. This study formulates five propositions to characterize the cross-boundary strategies of corporate policy entrepreneurship, a distinct form of policy entrepreneurship in a developing authoritarian state. The case study of mobile healthcare payment innovation in China finds that the corporate entrepreneur used a series of cross-boundary strategies adeptly that eventually made the innovation not only adopted in one locality but also rapidly diffused nationwide. These strategies were not used in isolation or in a pure stepwise fashion but appeared to be recursive and interactive, suggesting the dynamic nature of corporate policy entrepreneurship in a multilevel governance system. More studies could be done to further examine strategies and processes of other forms of policy entrepreneurship in various national and sectoral settings.     

盗窃罪中财产性利益占有的规范化解释进路

偷换二维码案的认定涉及诸多理论争议。通过对此类案件的构成要件定型分析可以发现,在涉事主体方面,行为人、商户、顾客三方关系是此类案件涉事主体的合理确定。无论是对于诈骗罪还是盗窃罪的行为定型方面,均存在难以解释的问题。特别是认为此类案件构成诈骗罪和新型三角诈骗的主张,在逻辑链条上无法有力地阐明其扩张解释的理由。对此,合理的解释路径是个别、例外地承认在此类涉及侵权行为以及民事请求权消灭的场合下,财产性利益的规范性占有的可能。这种规范化的理解虽然扩张了事实性的占有概念,但具有整体法秩序上的理由,并且符合刑法作为规范学的学科定位。与此同时,通过义务分配的功能性分析,也可以有效地区分不同情况,对于相关案件中的行为作出妥当的、符合罪刑法定原则要求以及司法实践需求的评价。     

Fatal Methemoglobinemia Due to Acute Inhalation of Methyl Nitrite in an Industrial Accident

Methyl nitrite is suggested to cause methemoglobinemia by generating methemoglobin, which may be lethal when the methemoglobin concentration exceeds 70%. However, intoxication with methyl nitrite is seldom reported compared with that with other nitrites. Here, we present an industrial accident involving methyl nitrite inhalation during its synthesis process that resulted in three fatalities and one survivor. The autopsy revealed conspicuous blue-gray discoloration in various parts of the body, including the skin, airway mucosa, vessels, brain, heart, and among other areas. The toxicological tests on the deceased showed methemoglobin concentrations in the blood over the lethal level and increased nitrite ion levels in the blood, gastric contents, liver, and lung tissue compared with those in control samples. The cause of death was determined to be methemoglobinemia-induced hypoxia due to methyl nitrite inhalation. This report provides evidence that in methyl nitrite intoxication, exposure duration has a significant influence on the postmortem changes and likelihood of a fatal outcome may be related to the age of the victim. More attention is required regarding the industrial hazards of this substance.
