美国的“政治大棒”与德国的法律程序——后“9·11”时代,美德反恐国际合作第一案之解读

"9·11"事件后,德美看似亲密的反恐合作关系却在德国法院审判"9·11"事件中的国际恐怖嫌疑分子穆特萨迪格和穆祚迪案中陷入了困境。两国政府在反恐策略上的差异为这两个案件的结局规定了方向。德国政府部门拒绝向德国法院提供关键证据,损害了德国检察官的指控能力。美国政府拒绝与德国法院合作,则直接冒犯了德国法院的自尊。由于审判是在德国民众反对美国入侵伊拉克以及阿尔布莱格监狱丑闻之爆发的背景下进行的,德国公共舆论同情被告人,积极影响并支持了法院的判决。这两个案件可以视为德国法院及民众对布什政府所实施的反恐策略的一次大审判,判决结果是布什政府败诉。     

美学三题

人类审美个性与其普遍性文化功能是德国古典美学两主题 ,其间存在的逻辑矛盾与历史张力以及其审美个性研究的不够深入 ,都深刻地影响了 2 0世纪中国美学。以宗教为参照 ,可以深化审美个性研究 ,则审美是人类追求即时性感性精神愉悦的活动。审美感性是物质感性、具体感性和即时感性 ,这些决定了审美乃人类精神生活起点、大众文化之典型代表。审美是最世俗的人类精神活动 ,美学则是人类感性精神现象学 ,这当是当代美学基础理论研究的确当起点。在拓展人类精神世界的深度和广度上 ,审美较科学、宗教、哲学均远为逊色。     

Intervention Theatre: performance,authenticity and expert knowledge in politicians’ travel to post-/conflict spaces

ABSTRACT

This article explores the role of official travel activities by politicians to post-/conflict spaces in German foreign policymaking. Starting from the observation that official travel justifications stress the value of authentic insights and unfiltered information, while journeys in practice are meticulously planned and staged, it asks what kind of knowing is possible, how actors make sense of the staged nature of field trips, and how multiple performances create and/or undermine notions of authenticity and first-hand expertise. The article shows that official on-site visits are composed of multiple conscious performances by all actors involved, but that these performances do not undermine the notions of authenticity and expertise. On the contrary, knowledge authenticity—or truth claims on the basis of authentic insights—and related expert authority are produced through travel-as-performance. The emphasis policymakers put on on-site presence and (the performance of) localized knowledge contradicts intervention literature’s generalized finding of a prioritization of technocratic over localized knowledge. The article draws on politics and performance scholarship and authenticity theories in tourism studies to make sense of a wealth of empirical material on the claims, practice and functions of German MPs’ journeys to post-/conflict spaces as part of broader political struggles over policy knowledge.     

Prediction of violent and sexual offences: A replication study of the VRAG in Switzerland

Abstract

The Violence Risk Appraisal Guide (VRAG) is a widely used actuarial risk assessment instrument and has been validated in different countries. However, there is no investigation supporting the predictive accuracy of the VRAG in the German language area. The VRAG scores of 79 violent and sexual offenders in Switzerland were assessed based on data from their psychiatric expert opinions. The VRAG scores were compared to subsequent recidivism as shown in the official criminal records. Consistent with past research in the English language area, the VRAG yielded a satisfying predictive accuracy (ROC area = .73), demonstrating its usefulness for risk assessment of violent delinquency in the Swiss cultural and German language area.     

Education cooperation in the European Union at the threshold of the New Millenium

The principles of ‘double relevance’ and ‘user-friendliness’ are seen as being essential for the implementation of the EU education programmes SOCRATES II and LEONARDO da VINCI II. Against the background of the acquis in EU education cooperation two points are explored: a) the articles of the Treaty are not fully used, and b) the framework set is increasingly proving to be too restrictive. The Luxemburg process and the Bologna conference are the reason for the second point. The opinion is put forward that the exchanges of students and teachers and the information exchange can be further europeanized and, eventually, be organized in permanent European structures. Split-ticket voting in German Federal elections, 1953–90: an example of sophisticated balloting?

Though the German electoral system has provided the opportunity of split-ticket voting since 1953, until now there has only been mere speculation concerning the rationality of ticket-splitting. In this paper we examine the rationality thesis empirically, using data provided by the official representative electoral statistics of the Federal Republic. Modifying the Downsian notion of rational voting, rational ticket-splitting is defined in terms of coalition building and of voters' expectations of the electoral success of candidates and parties. Applying this conceptual framework, it will be shown that the combinations of first and second votes actually chosen by a majority of the German electorate can rather be conceived of as a product of accident than of tactical considerations.     

“索拉娅案”评注——德国民法中对损害一般人格权的非物质损害的金钱赔偿

德国《民法典》对损害一般人格权的非物质损害的赔偿并没有进行规定,它是德国法中一项典型的判例法制度。联邦宪法法院通过“索拉娅案”的判决,确认了以往的审判实践和学说所建立的“一般人格权”法律制度的基本原则。通过对该判决书内容的研究,即可了解这一制度在德国发展的历史、当前的基本形态以及未来的趋势。     

德国行政强制执行的方式与程序介绍

德国行政执行法律是行政机关自力强制执行模式的典型代表,对许多国家和地区的立法都产生了重要影响。结合德国行政法学界的讨论与相关司法判例,解析该国行政强制执行的前提条件、强制手段以及程序等问题,理清《联邦行政执行法》与《行政程序法》之间的衔接,具有借鉴意义。我国行政法学在法律技术方面深受以德国为代表的大陆法系法学的影响,系统深入地理解德国行政执行法律制度,将有助于我国的《行政强制法》立法进程。     

Why Subjectivity Matters: Critical Theory and the Philosophy of the Subject

Abstract

In this paper it is argued that Habermas' critique of German Idealism is misguided and that his rejection of the philosophy of the subject is unjustified. Critical Theory needs to recognise the importance of subjectivity for all social philosophy if its theoretical aims are to be achieved. In order to demonstrate the relevance of subjectivity to Critical Theory the essay draws on analytic philosophy of mind and on the work of Manfred Frank and Dieter Henrich.     

Jewish joke telling in Muttersprache Mameloschn: performing queer intervention on the German stage

This essay explores the central role of Jewish joke telling in Sasha Marianna Salzmann’s play Muttersprache Mameloschn (first performed in 2012). Subversively revealing the problematic of essentializing cultural, national, and even sexual identity, Jewish joke telling figures as a performance of social and political resistance and disidentification in this play. Engaging with Jack Halberstam’s queer epistemology of failure and José Esteban Muñoz’s theory of queer disidentification, I propose that the act of Jewish joke telling by a young lesbian plays out as a new queer project of intervention in this play that confronts both antisemitism and culturally positioned sexual hegemony.
