气候变化的国际法发展:从温室效应理论到《联合国气候变化框架公约》

本文考察了温室效应理论对缔结《联合国气候变化框架公约》的决定性影响 ,并对《联合国气候变化框架公约》的基本法律原则 (规则 )及其对国际环境立法的贡献进行了述评。     

美俄关系的变与不变——兼议美俄"新冷战"说

美俄关系经过近十年的磨合大体形成了相对稳定的关系框架,但这一框架未能根本解决两国之间存在的结构性矛盾。伊拉克战争终于将这些矛盾催生出来,于是引发美俄关系新的紧张,也诞生了所谓“新冷战”说。笔者认为,与其说美俄关系处于“新冷战”,不如说是回归其本应有的面目。未来美俄关系的发展将取决于国际环境、双方各自战略走向及两国领导人的更迭三个层次的因素,具有一定不确定性。     

金融危机后日本银行货币政策框架演变与启示

为了应对全球性金融危机对金融系统的冲击,日本银行采用了极为宽松的货币政策,在灵活调整货币政策框架的同时运用了大量传统和非传统的政策工具。文章主要从货币政策目标、货币政策工具以及货币政策传导机制三个方面考察了金融危机后日本银行从传统货币政策体系框架向量化货币政策体系框架的演变过程。日本银行的政策实践对我国进一步完善货币政策框架有一定的借鉴和启示。     

Policy Narratives across Two Languages: A Comparative Study using the Narrative Policy Framework

The Narrative Policy Framework (NPF) focuses on the role of narratives, drawing from a rich scholarship in narrative, language, and culture. Despite the understanding that narratives are constructions of language and that narrative construction differs across languages, NPF studies have not focused on policy narratives in languages other than English. Language characteristics of narratives are important to assess the stability of policy narratives when there are multiple dominant languages in a political system. This study investigates the use of narrative elements in policy narratives in agricultural biotechnology policy in India across Hindi and English media coverage to examine the NPF assumption that narratives have generalizable narrative elements irrespective of variation in linguistic context and, specifically, tests the transportability of narrative elements. Findings validate the transportability of narrative elements in Hindi narratives, indicate variation in the use of narrative elements over time, and have implications for applying NPF across languages.     

《烟草控制框架公约》第11条对我国烟草制品包装的影响及对策研究

《烟草控制框架公约》是在世界卫生组织主持下通过的第一份国际条约,第11条对烟草制品包装和标签作出详尽而严格的规定.为了履行公约义务,我国对现有相关立法进行调整和完善,通过制定《境内卷烟包装标识的规定》等国内法,总体达到《公约》的要求.我国烟草行业要将“做精做强”作为应对《公约》的最根本的措施,积极应对挑战,在挑战中求发展.     

英国高校科研评估政策及其借鉴意义

自1986年以来,科研评估政策(RAE=Research Assessment Exercise)开始在英国高校实施,至今共进行了6次,在英国国内和其他国家引起了广泛的关注。本文主要论述了英国高等教育科研评估及其发展历程、作用以及存在的不足,同时还涉及它与作为高校科研评估替代品的科研卓越框架(REF=ResearchExcellence Framework)之间的联系与区别,以期对中国的高校科研评估有所启示。     

我国事业单位制度变革的路向与策略——一个公共治理的分析框架

在公共治理框架下的我国事业单位变革的总体思路应该是统筹规划,全盘布局,分类改革,分立政策,分别引导,分层操作,通过深层次制度变革和配套政策引导,将现存的事业单位各自引导成长为不同的社会治理主体部分,从传统的一元治理模式(即政府管理社会事务)向多元治理模式(即政府、企业、第三部门共同治理社会事务)方向发展。其中公益性事业单位的改革是我国事业单位改革的重点和难点,要针对这类事业单位改革目标进行二次认定,区分为政立事业单位和社立事业单位,并设定各自的改革方向和变革路径。     

以公共价值为基础的政府绩效治理——源起、架构与研究问题

政府绩效管理兴起二十多年来,已由西方国家应对财政和信任危机、提高行政效率的工具拓展为各国政府改革和创新的重要内容,新公共管理的实践价值和理论优势在其中都得到了充分体现。但其理论缺陷和实践中的困惑,特别是在公共价值方面的冲突使学术界的探索从未停止过。本文通过对中国、美国、日本等国的实践案例考察,从制度变迁和公共行政学术史两个层面的质性研究,提出了以公共价值为基础的政府绩效治理理论体系框架。文章首先从"公共性"、"合作生产"和"可持续"三个方面对新公共管理背景下的政府绩效管理进行了反思,认为公共价值对政府绩效合法性具有本质的规定性。其次,初步论证了以公共价值为基础的政府绩效治理的两个基本命题——政府绩效是一种社会建构、产出即绩效;认为只有来源于社会的政府绩效才能获得合法性基础,也只有根植于社会的政府绩效才能产生其可持续提升的需要,这是政府绩效管理的根本动力;而在政府绩效价值建构基础上的科学管理,才能保证政府产出与社会需求的高度一致,充分体现科学管理的价值。再次,从这两个基本命题出发,以价值管理和管理科学理论为基础,构建起了以公共价值为基础的政府绩效治理模型,并对模型中政府绩效的价值建构、组织管理和协同领导系统等主要内容进行了阐述。最后,从模型如何"落地"、政府绩效管理的价值分析和研究拓展等方面提出了未来的研究方向。     

Erzählungen des Kindes‐ und Erwachsenenschutzes: Eine Anwendung und Erweiterung des Narrative Policy Frameworks

The Child and Adult Protection Authorities (KESB) have been the subject of controversial discussion since their establishment in 2013. The reform of the Guardianship Law provided for an institutional shift away from local guardianship authorities to regional specialist authorities. This article uses the Narrative Policy Framework (NPF) to examine the history of today’s controversy, simultaneously proposing an analytic strengthening of said framework. Previous NPF studies summarize policy actors into opponents and proponents. As a result, we do not know whether different actors use different narratives. We therefore separate the expert from the MP discourse. The analysis shows that the experts' arguments for a new institutional arrangement and a person‐oriented narrative dominated, which put the fundamental rights of the persons affected by guardianship measures up front. The study contributes to the understanding of the current controversy, in which a person‐oriented narrative seems to be dominant again, directed against the new authorities.     

Weighing Ethical Considerations in Proposed Non-recent Child Sexual Abuse Investigations: A Response to Maslen and Paine’s Oxford CSA Framework

Questions about when it is right for police forces to investigate alleged offences committed in the more or less distant past have become increasingly pressing. Recent widely publicized cases of child sexual abuse (CSA) and exploitation, sometimes involving high profile individuals, have illustrated the ethical, psychological, and forensic complexities of investigating non-recent child sexual abuse. Hannah Maslen and Colin Paine have developed the Oxford CSA Framework to assist police to weigh the various ethical considerations that militate for and against initiating a CSA investigation. While such a tool is to be welcomed, and while there is much that is helpful in Maslen and Paine's approach, we suggest that the Oxford CSA framework could be strengthened. Our first suggestion is to abandon a proposed distinction between a set of considerations that is said to generate a “presumption” in favor of investigation and other considerations that may supplement or oppose this presumption. Our second suggestion is to review the weightings applied to the considerations within the model, which lack clear justification and create problematic effects. Finally, we suggest that referring the Oxford CSA Framework to a panel with lived and professional experience of CSA could serve important procedural justice goals and enhance the Framework's recommendations.
