Reasonable expectation of privacy is discussed in the context of searches conducted without the warrants usually required by the Fourth Amendment but with the consent of a third party, who is not the target of the search. Case law on this issue is neither consistent nor clear-cut. Psychological theory and research clarify this issue by establishing closer correspondence between legal concepts and assumptions and individuals' actual behaviors and social expectations. The key legal components of reasonable expectation of privacy are delineated, with regard to third-party consent: “common authority” areas versus “exclusive use” areas and theassumption of risk doctrine. Next, the psychological theory and research on interpersonal relations and human territorial functioning are reviewed as they relate to the legal components of privacy regulation. Taken together, the legal criticisms of this warrant exception category, and possible discrepancies between the legal assumptions concerning interpersonal and territorial functioning among co-residents and the actual behaviors and expectations suggested by psychological theory and research, raise questions about its validity.  相似文献

The author responds to comments reappraising “Critical Legal Histories” (CLH) (1984). CLH critiqued “evolutionary functionalism,” the idea that law is a functional response to a typical modernizing process. CLH argued that “society” was partly constituted of legal elements and that law was too indeterminate to have reliably regular functional effects. CLH has been misinterpreted as calling for a return to internal histories of “mandarin” doctrine: all it said was that some doctrinal histories were valuable, without privileging them. This response clarifies that the relations of law to society and social change, and of high‐level official law to everyday local law are distinct issues. CLH is mostly moot today, since social‐legal historians have incorporated its insight that legal concepts are embedded in everyday social practice. But other fields have revived deterministic Whiggish accounts of progressive development and of law functional to it—to which CLH's critique still seems relevant.  相似文献

In the present essay, I consider the relevance of evolutionary psychology (EP) for legal positivism, addressing the two main traditions in the legal positivist family: (1) the tradition I identify with the works of Hart and Kelsen and characterize as “normativist,” as it tries to describe law as a purely or, at least, as an essentially normative phenomenon, while remaining true to the ideal of scientific objectivity and value‐neutrality; (2) the tradition I broadly refer to as “legal realism,” which equates law with adjudication and “legal science” with the task of explaining judicial behaviour.  相似文献

Since the 1960s, the application of psychological services and research to law enforcement settings (known as “police psychology”) evolved from being practically nonexistent to almost universal in a relatively short period of time (Scrivner 2006). Currently, psychologists provide a variety of services to law enforcement agencies, including performing evaluations for pre-employment selection, “fitness-for-duty” evaluations (FFDE), and counseling/treatment for psychologically troubled officers and first responders. The extensive use of personality assessment instruments in police psychology is not surprising given the fact psychologists have traditionally concerned themselves with issues of psychological measurement and test construction. In the contemporary practice of police psychology, assessment using personality measures is essential, being utilized in all of the abovementioned evaluations, in addition to other occasional applications (Weiss et al. 2008). 在包括赵春华案在内的诸多引发舆论关注的争议案件中,法官或许并非不是不懂得如何利用社科法学的判断能力与法教义学的裁判技术去弥合司法标准与公众认知之间的巨大断裂,而更可能是基于其“父爱”式的社会“管制”取向而对司法后果的实质合理性问题做出了“爱之深,责之切”的价值决断。在中国特色社会主义法律体系已经形成的历史背景下,为了保证良法的颁行能够导向预期的善治,法律必须以其作为“社会交往机制”的系统潜力而彰显其公理性与司法的合理性。只有首先确立基于交往原则和承认社会自主性的权力逻辑与法律决策结构,那种体现“人性化”“人文化”和“人权化”的方法论逻辑才有可能在法律的运作中获得国家体制官僚无法武断拒斥的实效。  相似文献

The International Court of Justice (ICJ) advisory opinion on the Legality of the Threat or Use of Nuclear Weapons in 1996 was a landmark case because, for the first time in history, the legal aspect of nuclear weapons was addressed. The decision has evoked controversies regarding the Court’s conclusion, the legal status of international humanitarian law in relation to nuclear weapons, and a newly introduced concept of state survival. While much legal scholarship discusses and criticizes the legal significance of the opinion, there has not been enough scholarship examining the Court’s specific choice of words and concepts that sustain its wider ideological and political position in the opinion. The paper argues that the Court’s vague and controversial logic is attributed to its confrontation with two international orders/codes: the legal order (or international law) and the political order (or state practice). The paper engages in legal semiotics as methodology to decode legal text and discover a deep structure that sustains networks of codes, according to which text is interpreted. Through the semiotic examination of three sets of key concepts (1) “permitted” and “prohibited,” (2) “threat of use” and “possession of the weapon,” and (3) “state survival,” the paper shows the ICJ’s confrontation with two orders/codes and eventual prioritization of the political order over the international legal order. The analysis of the opinion based on legal semiotics indicates an intimate and inseparable relationship between state practice and international law, which must be disentangled for the sake of the rule of law.  相似文献

In the interface of psychology and law in civil proceedings, such as in cases of psychological injury in tort, psychology can help in arriving at just and fair legal decisions that are appropriate in context. In the same way that the interface of law and psychology has brought about the development of “psycholegal” assessment methods, parallel forms of psycholegal interventions are beginning to emerge as well. What distinguishes them from traditional forms of psychotherapy is that their administration requires an integration of both legal and psychological knowledge. Divorce mediation, treatment of incompetence to stand trial, and other examples are shown to fall within this new category of interventions. A conceptual model for the development of psycholegal interventions is presented. Forensic mental health professionals are urged to approach their development more systematically.  相似文献

Lawyers have traditionally viewed law as a closed system, and doctrinal research has been the research methodology used most widely in the profession. This reflects traditional concepts of legal reasoning. There is a wealth of reliable and valid social science data available to lawyers and judges. Judges in fact often refer to general facts about the world, society, institutions and human behaviour (“empirical facts”). Legal education needs to prepare our students for this broader legal context. This paper examines how “empirical facts” are used in Australian and other common law courts. Specifically, the paper argues that there is a need for enhanced training in non-doctrinal research methodologies across the law school curriculum. This should encompass a broad introduction to social science methods, with more attention being paid to a cross-section of methodologies such as content analysis, comparative law and surveys that are best applied to law.  相似文献

A classic debate in the history of philosophy is that between rationalists and empiricists concerning the “true” source of human knowledge. In legal philosophy this debate has been reflected in the classic opposition between natural law and legal positivist perspectives. Even the currently predominant inclusivist perspectives on the nature of law, such as inclusive legal positivism and inclusive legal non‐positivism, are not immune to such a dichotomy. In this paper I attempt to present an understanding of specific cognitive characteristics of prevailing legal theories from the perspective of the theory of psychological types as developed by Carl G. The idea that particular legal institutions are artifacts is not new. However, the idea that the “law” or “legal system” is itself an artifact has seldom been directly put forward, due perhaps to the ambiguities surrounding philosophical inquiries into law. Nevertheless, such an idea has recently been invoked more often, though not always developed in detail in terms of what the characterization of the “law” or “legal system” as an artifact entails ontologically, and what consequences, if any, this has for philosophical accounts of law. As a result, the primary aim of this paper is to attempt an inquiry into what the claim that “law” by its nature or character is an artifact entails, and what an artifact theory of law might look like.  相似文献

从“有法必依”到“公正司法”喻示着一种刑事司法观的应然转变:放松了司法者对法律文本本身严格服从的要求,更加强调文本之外的个案公正、合情理等实质合理性依据。这对破解当下具有普遍性的法条主义裁判思维,无疑是一种很好的政策支持和启发。按照罪刑法定原则本意进行合乎逻辑的推演,绝不能推导出“法有明文规定即可定罪处罚”的结论。韦伯关于中国古代司法系“卡迪”模式(即“非理性”)的论断具有一定的事实依据及合理性,这种卡迪模式对实质公正的追求具有目的正当性,不宜将此简单视为“恣意司法”的代名词,其中体现的能动性判断具有司法出罪维度的意义。在目前刑法体系下,法的公正价值与法的安定性并不存在冲突,出罪的理论依据与规范依据完全可以得到恰当融合,但在法适用中需要缓和法的命令性要求。恰当的说理论证是嫁接法的安定性与个案公正的纽带,该过程实际上是将合情理、合目的等价值考量揉入刑法文本的理解、适用及说理论证过程当中。  相似文献

基于法律的独特语境,“法律”概念的使用和翻译不可避免地是复杂的。在近现代随着各个民族国家交往的深入展开,这样复杂地使用和翻译的背后隐藏着许多“重要故事”。我们可以认为,法律的存在其本身就意味着纠纷的存在,纠纷不仅可能是个人的,而且可能是广义社会的或说民族国家的,后者在特定时期可能是更为重要的。在纠纷中,随着人们的利益、观念、立场或者态度的不同,这种不同同样又是不可避免的,“法律”概念的一般含义因而也会裹挟在利益、观念、立场或者态度中表达自己的“差异”。因此,应当揭示使用、翻译背后的话语实践。  相似文献

拉伦茨方法论体系的基础是欧洲传统的“名判”逻辑技术,其目标是达到个案的公平判决。当作为裁判依据的总体法与条法不足时,法官可“续造法”。所续造的“法”不是条法,而仅是为达到公判而对诸条法的自主运用,它应该有“现行法”的拘束力。为使体系内自主运用条法成为可能,本来不足的体系内“条法库”由审判员以诸种技术补足。介于法律准则之间的或宪法内条法的不谐则依赖“法益衡量”技术解决。因片面突出法官的自主地位,拉伦茨方法论在本质上是现代法治社会一种尚需调制的折衷系统。  相似文献

Abstract. Justice as a manifestation of “the just” is an evasive concept. On the one hand there is the law, an operation run by professionals. On the other hand there are the citizens the law is meant for. Generally speaking the law strives for justice. But the law has to protect many different interests and must work through legal devices. Therefore the justice that emerges from it is necessarily a legal compromise. For the citizens the legal rules are a given reality. Generally they will agree that the law is there to achieve justice but legal arguments that justify a rule or decision cannot have the same value for them. In cases that affect them personally, justice will be a personal, existential experience, which may be incompatible with legal justice. It is hard to keep these two forms of justice under one roof. In order to make this easier this paper proposes a conceptual split between “law‐linked justice” and “existence‐linked justice.” It is argued that the law cannot in truth to its rational origin ignore the citizens’ experience of justice, out of the ordinary as they may be.  相似文献

“复仇”制度作为宗法伦理社会的伴生物,孝义是其得以产生并持续存在的精神基础。离开了“孝”,“复仇”制度便不可能产生和长期存在下去。在对“复仇”的态度上,各朝代的统治者从一定程度的肯定到逐步的限制,到最后的明令禁止“复仇”。其态度的变化反映了儒家孝义思想与传统中国国家司法主义之间矛盾的日益凸显。虽然“复仇”制度在国家司法主义的挤压下活动的空间大大的萎缩,但对“复仇”制度禁而不止的现象却与封建社会相始终。在法治现代化进程中,破除“人情大过国法”的观念,除了在理论上进行宣传“法律至上”的观念,在全社会树立法律意识以外,更为根本的是加速我国社会从传统的农业社会向以市场经济为特征的工业社会的转型。  相似文献

本文主要对法律与逻辑关系进行了全面的探讨。对逻辑学和法学之间交叉性的一些问题进行了回顾和总结。首先,探讨了什么是“法律逻辑”,并重点介绍了我国学者较陌生的“规范逻辑”,将两者进行了比较;其次,对法理学和逻辑学都关心的“法律推理”问题进行了探讨,比较了“法律推理”和“司法推理”两者的异同,以及两大法系“法律推理”的特点和差异;最后,对饱受批判的“法律形式主义”进行了研究,指出应当辩证地看待“法律形式主义”的功与过。最后,作者结合我国的实际,认为:我们不能借口反对“法律形式主义”而忽视和否定逻辑在法律领域中的作用。  相似文献

American political culture is both seduced and repulsed by legal power, and this essay reviews Gordon Silverstein's contribution to understanding the causes and consequences of “law's allure.” Using interbranch analysis, Silverstein argues that law is dangerously alluring as a political shortcut, but ultimately he concludes that law offers no exit from “normal politics” and the hard work of “changing minds.” This essay suggests that Silverstein's framework—his dyadic focus on courts and Congress, constructive and deconstructive patterns, legal formality and normal politics—strips law from its animating context of interests, inequality, and ideology. Without consideration of these larger forces of power, Silverstein's framework misplaces law's ability to “change minds” in perverse and unexpected ways.  相似文献
