Arms transfers beyond the state-to-state realm can have harmful effects for international security dramatically affecting the relations and behavior of states. This article examines why an emerging international norm on "prohibiting states to transfer arms to nonstate groups" has failed to diffuse at the international level. It discusses the already available international law framework existing at the regional and international levels upon which the potential norm could be built. The failure of the norm to diffuse at the international level can be primarily explained by the existence of a long-consolidated norm: the customary practice of states to transfer weapons to nonstate actors, that is, groups they deem legitimate to, without any interference or constraint. 1 The unrestrained transfer of weapons is an established foreign-policy practice. It is the way states form, uphold alliances, extend friendships, and build spheres of influence ( Sorokin 1994 ). Clearly, no state willingly wants to give this up. Therefore, the multilateral agreement on a norm barring most or all transfers of weapons to nonstate actors would curtail the freedom of action to build spheres of influence as states please. There are genuine ethical and moral dilemmas in this discussion, a nonstate actor may be a freedom fighter or a terrorist depending on different perspectives. The distinction between the categories "state" and "nonstate" actors may risk classifying actors in two camps: the good and the bad, respectively. This is problematic as a few states are known to be the most brutal perpetrators of egregious violations against their own citizens, whereas certain nonstate actors are legitimately fighting for the protection of vulnerable populations.  相似文献

Lethal drones or unmanned combat aerial vehicles have been used to kill thousands of persons suspected of complicity in terrorism. Despite concerns aired by legal scholars that drone strikes outside areas of active hostilities violate international law, the US government contends that targeted killing is distinct from assassination, and has persisted in the practice to the point where it has become normalised as a standard operating procedure and taken up by other nations as well. Drone strikes have been championed by Western politicians as a “light footprint” approach to war, but the institutional apparatus of remote-control killing rests on totalitarian, not democratic principles. Secretive targeting criteria and procedures are withheld from citizens under a pretext of national security, resulting in a conflation of executive with judicial authority and an inversion of the burden of proof, undermining the very framework of universal human rights said to be championed by modern Western states. Moreover, lethal drones hovering above in the sky threaten all persons on the ground with the arbitrary termination of their lives and as such represent a form of terrorism no less than the suicide bombings of jihadist groups such as Al Qaeda and ISIS.  相似文献

This article advances a counter-intuitive argument about what are argued to be the links between security and development in human security. The argument is counter-intuitive because the merging of development and security is explicitly part of the human security discourse. However, this paper will argue that human security can better be understood not through its own discourse, but placed in the context of the changing relationship between the developing world and the developed world after the end of the Cold War. Rather than the merging of security and development it will suggest that human security is representative of a period in international relations in which there is a separation of security and development. The broader international context is one in which the developing world is less of a security concern to the developed than was the case during the Cold War.  相似文献

Fragile states     
Since the 1990s, states that lack the capacity to discharge their normal functions and drive forward development have been referred to as ‘fragile states’. This article focuses on Africa, which not only has the largest concentration of prototypical fragile states, but has been the focus of attention for scholars, international development agencies, and practitioners. The author reviews competing analyses of the post-colonial African state and concludes that its characteristics of weak institutions, poverty, social inequalities, corruption, civil strife, armed conflicts, and civil war are not original conditions, but are rooted in specific historical contexts. It is essential to understand both the external and internal factors of fragility if such states are to get the assistance and empowerment that they need – not only for the benefit of their impoverished citizens, but also for the sake of global peace, prosperity, and security. Ultimately, it is the citizens of the countries concerned who are responsible for determining when states are no longer fragile – not ‘benevolent’ donors and the international community, whose prime motivation for interventions supposedly to strengthen the state is to ensure that fragile states find their ‘rightful’ places in the hegemonic global order.  相似文献

东盟安全机制以"东盟方式"著称,基于东盟的经验事实,本文认为,国家间协调是理解东盟安全机制的恰当理论框架。在此基础上评估了东盟安全机制的绩效:在抑制成员国内部冲突、化解东南亚地区国家间争端方面取得了积极效果。同时,由于东盟国家利益分歧,安全合作领域数量少、程度浅;东盟安全机制是中小国家之间的协调机制,其治理能力有限,无法单独解决地区重大安全问题,需要与外部大国相配合;东盟国家对主权独立格外重视,在安全领域缺少制裁机制,导致领土争端无法在区域内得到解决。面对本地区的复杂安全形势,东盟对内需要拓宽、深化安全领域的合作,对外需要加强与大国的安全合作。  相似文献

Why do states create enforceable international human rights norms that empower third parties to prevent and sanction domestic human rights abuses? Recent theories suggest that international institutions are shaped not only by power and interests but also by the content of arguments during intensive communication and argumentation processes. Moving beyond the simple notion that "communication matters," I argue that states are likely to be persuaded by arguments that draw on widespread taken-for-granted norms, in particular, prohibitions on bodily harm, the importance of precedent in decision making, and the link between cooperation and progress. This model extends previous theories by specifying mechanisms and scope conditions for international change through persuasion. I illustrate the argument by examining the convention against torture, a costly international institution that allows domestic courts to prosecute crimes that occur in the territory of other states (universal jurisdiction). Because of its enforcement mechanisms, the torture convention poses a difficult case for theories explaining international institutions. If persuasion models can explain even costly institutions, they should be more widely considered as explanations for all kinds of international institutions.  相似文献

Different from the perspective of traditional national security, human security is an essential component of non-traditional security. Human security is influenced by multi-dimensional factors. Human security will be threatened if one or more of these dimensional factors get twisted. Such threats, once accumulated to a certain level, may trigger a confl ict. While some factors may have a low correlation with confl ict, some other factors may have a multiplying effect in triggering the confl ict. Further, confl ict may be triggered by a single factor or multiple factors. Poor governance may lead to escalation of confl icts. Deep understanding of triggering effects and their correlation with confl icts is essential to addressing the root causes and the management of conflicts effectively. Concepts of human security, state responsibility of protection and neo-interventionism have been developed in succession. Though the people-centered security framework draws global attention, it should be recognized that there is no international consensus on an optimal type of governance. However, according to the Charter of the United Nations, the primary responsibilities of human security protection should be rested on the government of a state. The principle of sovereignty remains the fundamental principle of international relations, which should be the guiding principle for addressing human security issues.  相似文献

深海区域是重要的全球公域,其丰富的资源储备和巨大的军事战略价值成为吸引世界各国深度参与深海开发的重要诱因。近年来,各国深海力量投送的不断加强,也在国际深海领域造成了如生态安全、军事安全、经济与资源安全以及人身安全等各种传统及非传统安全问题。国际深海安全问题的出现,会对深海开发的良性发展产生严重的影响。因此,重视和加强对国际深海安全问题的治理迫在眉睫。现阶段,国际社会在相关国际法和国际机制的基础上,已经初步形成了以国际海底管理局等国际组织和主权国家共同参与的总体治理架构。但是,现阶段的国际深海安全治理还存在着治理主体层次不够多元、军事等传统安全领域的治理相对乏力等亟须解决的问题。近年来,中国在和平利用国际深海资源方面,发展迅猛。进一步关注国际深海安全问题、有效参与国际深海安全治理,对于中国而言意义重大。在此背景下,中国可以在进一步有效感知深海安全问题、夯实参与国际深海安全治理的实力基础以及打造深海“人类命运共同体”等方面进一步着力。  相似文献

International human trafficking—sometimes referred to as modern-day slavery—has increasingly come to be seen as a security threat. The question remains as to what kind of threat human trafficking poses. Traditional security approaches to international human trafficking call for analysis of trafficking as a threat to the state and to state control of borders. Traditional security analyses of trafficking therefore emphasize border security, migration controls, and international law enforcement cooperation. Feminist analyses of human trafficking challenge the traditional security framework, prioritizing the security of trafficked persons and recognizing the manner in which victims are threatened by both traffickers and the state itself. I argue that feminist approaches to human trafficking are essential for understanding and combating the phenomenon. Feminists identify the ethical and pragmatic grounds for broadening the analytical focus from states to people. Feminists' most important contribution, however, lies in the investigations of the social construction of human trafficking, which highlight the destructive role that sexist and racist stereotypes play in constructing the category of trafficking victims.  相似文献

The complex relationship between international norms and transational networks of non-state actors is gaining increasing attention in international relations theory. This paper argues that transnational networks of non-state actors gain greater access to and influence over states when they identify with international norms that the states themselves have formally accepted--even if that formal acceptance did not initally reflect any serious intention to implement or monitor the norm in question. This process has been called the 'boomering effect'. The resulting redefinitions of state interests raise the diplomatic salience of the norm in question, and thereby increase its effectiveness. The article illustrates this process with a study of changes in the US foreign policy towards Soviet and Eastern European compliance with the human rights norms of the Helsinki Accords in the mid-late 1970s.  相似文献

与传统的“国家安全”观相比,“人的安全”观是非传统安全领域中的重要内容。人的安全受多维度影响。其中一个或几个维度出现问题,人的安全就受到威胁;威胁达到一定程度,就可能导致冲突。这些维度构成冲突诱因。冲突诱因呈现多元化。有的诱因与冲突相关度较低,有的诱因对诱发冲突具有乘数效应。就触发状态而言,冲突可能由单一因素诱发,亦可由多种因素叠加引发。如果治理失当,会导致冲突恶化。一个国家要有效地治理冲突,就应当对导致冲突的诱因及相关度有深刻理解,如此方可对症下药。人的安全概念、国家保护责任与新干预主义是相继形成的三个概念。应当说,尽管以人为中心的安全框架日益被全球关注,但应当采取何种治理形式,何种治理形式属于最优方案,在国际社会中并未达成共识。但是,根据《联合国宪章》的精神,保护人的安全的责任首先在于当事国政府。主权原则仍是国际关系的基本原则,是解决人的安全问题必须遵守的根本准则。  相似文献

"人类安全"逐渐成为一种新的安全理念,环境气候问题等各种影响人类安全和福祉的非传统安全问题日益引起广泛关注。全球性安全威胁的严重程度则取决于治理框架的反应能力。包括气候政策、法律和机构在内的气候环境治理框架能够最大限度地削弱全球化冲突的根源,避免影响的发生或减缓其进程。奥巴马上任以来美国新政府能源、环境和应对气候变化政策出现较大调整,大力推动新能源法案来减缓气候变化。这一政策转向具有深刻的历史动因和政治基础,并将给美国经济复苏和美国企业的国际竞争力带来压力,加剧美国对外贸易摩擦和削弱其在国际气候环境合作中的领导地位。  相似文献

Most states have numerous paths to create security for themselves.Foreign policy-makers must recognize that their own securitypolicy will initiate a process that structures the nature ofthe domestic competition over domestic and foreign policy inother countries. I contend that one state's security alternativecan empower or weaken domestic actors and interest groups inopposing foreign powers. I term this process the ‘secondface of security’ since it entails a less direct and morenuanced method of creating security (in contrast to the ‘firstface of security’). I apply this model to explain theintent of Britain's ‘smart’ or targeted appeasementpolicy during the 1930s – to strengthen conservative business,government officials, and economic circles in banking, lightindustry and finished goods, and even heavy industry in orderto steer Tokyo and Berlin away from rearmament and extreme autarky.  相似文献

Weighted voting institutionalises inequality in international organisations. How is it possible that states accept rules that formally privilege some over others even though this contradicts the sovereign equality of states and norms of democratic decision-making? This contribution to a special issue about global stratification shows that arguments about equality can actually serve to justify inequality in international institutions. This can be seen in moves by the German government to justify its proposals for a reform of voting in the Council of the European Union (1995–2008). Successive German governments focused on arguments about democracy based on the equality of states and of citizens to justify their push for a more privileged position for Germany in the Council. Efficiency also figured as a justification but was clearly less prominent.  相似文献

International security cooperation usually takes one of two forms. A classical collective security organization is designed to promote international security through regulating the behavior of its member states. A defensive security organization is designed to protect a group of states from threats emanating from a challenging state or group of states. Both forms of security cooperation bind states to act in concert with respect to threats presented by other states. The emergence of non-state actors such as terrorist or extremist organizations challenges traditional forms of collective security. Threats from political extremism, terrorism, and outlaw organizations have grown in visibility during the past decade in the countries of Eurasia. The terrorist attacks of September 11 and the ensuing global war on terrorism have given added impetus to the Eurasian inter-state cooperation in confronting non-traditional threats and challenges from non-state actors. Bearing in mind the theory of collective security, this article analyzes threats posed by non-state actors with respect to Eurasian collective security organizations including the Shanghai Cooperation Organization, the Conference on Interaction and Confidence Building Measures, and the CIS Collective Security Treaty Organization. The article concludes that the effectiveness of these organizations at achieving stated objectives depends upon their capacity to adopt new criteria of effectiveness.  相似文献

二战后,世界政治经历了"平靖进程",具体体现为:"大国罕有战事""国家罕有消亡"。本文融合国际政治经济学与国际安全研究,展示二战后的技术变迁改变了大国的"意愿"与"能力",支撑了世界政治新变化。在马尔萨斯时代,由于技术水平低下,生存物资稀缺,生存保障匮乏,人类面临持续的安全难题。二战后,技术发展影响了当代大国的"意愿"与"能力",让世界政治呈现新变化。技术变迁给大国提供了更为丰富的选择,让大国使用武力征服的意愿降低;同时,随着技术变迁,尤其是在"核革命"后,大国确保自身安全的能力更强,使得"大国罕有战事"。得益于技术变迁,大国利益半径扩大,即便距离遥远地域的变化也与自身息息相关,大国保障遥远海外利益的意愿提升;同时,技术变迁扩大了大国的权力投射,让世界各国,尤其是大国保障体系稳定的能力更强,致使"国家罕见消亡"。随着技术变迁,世界政治已呈现出很多与传统智慧不同的方面,孕育国际交往的新理念。  相似文献

In forbidding the use of force except in self‐defence against armed attack or when authorised by the Security Council, the UN Charter appears to be the culminating development of a system of international order based on the doctrine of state sovereignty. The cumulative result of international‐law‐related acts, omissions and declarations of the Bush administration since its inception can be construed as a fundamental challenge to the sovereign state system. The administration's stated security strategy is one possible response to undoubtedly grave challenges to national and human security. In fact, only an institutionalised partnership between the US and regional powers such as China, India, Brazil and Germany can hope to address those challenges successfully, in part because only it would have the requisite legitimacy. That partnership or concert could be organised within the UN framework, albeit intensifying its hierarchical elements.  相似文献

ABSTRACT

Previous research has primarily focused on the EU’s high-profile involvement as direct mediator in peace negotiations. Conversely, less attention has been devoted to the EU’s support to third parties’ mediation efforts, which is a significant component of its mediation activities. Addressing this research gap, this article develops a conceptual framework for the systematic analysis of EU mediation support, identifying key mediation support techniques and the conditions for their success. In terms of mediation support techniques, the EU may rely on “endorsement”, “coordination”, “assistance”, and “lending leverage” to empower and steer third party mediators in line with its mediation objectives and values. We illustrate the utility of the conceptual framework for the EU’s support to IGAD in mediating in South Sudan’s civil war. We find that the EU has contributed significantly to IGAD’s empowerment in terms of endorsement, coordination, assistance, and lending leverage. Simultaneously, our analysis also points to important challenges in the EU-IGAD relationship, which relate to challenges concerning strategic engagement with IGAD’s internal politics that are marked by diverging interests and ties of its member states to the conflict parties.  相似文献

Security sector reform (SSR) policy has, for the better part of a decade, been viewed as instrumental to the larger international project of improving and strengthening the ‘capacity’ of post-conflict and ‘fragile’ states. The current policy approach, which represents a merging of security and development agendas in the post-Cold War era, is based on the premise that fragmented, ineffective, poorly managed and politicised state security institutions threaten political stability and undermine poverty reduction and sustainable development goals. The objective of this article is to examine aspects of what has been described as the ‘SSR policy-practice gap’ that arose in the course of implementing SSR policy in Timor-Leste by analysing the systemic basis of the gap. An analytical framework that untangles the relationship between SSR policy objectives, targets and outcomes is presented in concert with a discussion of the social and political circumstances that confronted international organisations and donor countries when they sought to implement SSR policy in Timor-Leste. By using the analytical framework to assess the policy coherence between SSR objectives and the SSR programme contained in UN Security Council Resolution 1704, the ubiquitous disconnect between SSR ‘Gospel and Reality’ is pulled more sharply into focus.  相似文献
