How High-Yield Farming Saves Nature

High-yield farming—more agricultural output per acre of farmland—has been a boon to mankind and to nature. If today’s agricultural efficiency was the same as in the 1950s, the world would need three times the cropland to produce today’s food supply. That would mean that 15-16 million mi² of forest would have been destroyed—all the global forest area available today. Rising population and increased affluence will require a tripling of agricultural efficiency in the next 50 years if we are to protect wildlife at the same time. More investment in agricultural research and education will be required, but this is what produced the previous green revolution.

The Freedom of Expression in Global Perspective

This paper presents recent events including the Danish cartoon crisis occasion—a re-examination of John Stuart Mill’s argument for freedom of expression. Despite the appeal of liberalism, Mill’s philosophy had from the start been subject to intense criticism. The rise of political Islam opens a new phase in the debate; the difficulties pointed out by Mill’s critics are indicative of the obstacles that liberalism still faces.

Socialist Heroes in East German Schoolbooks

Based on examples of socialist heroes from East German schoolbooks and teaching guides designed for elementary school, this essay examines the role of state ideology in primary education. It assesses the German curriculum of the now-defunct German Democratic Republic (GDR) and illuminates distinctions between civic education and political propaganda. It also shows how the curricular emphasis on socialist virtue helped to form “the socialist personality.”

Yahoo? Reining in the Wild West with the Alien Tort Claims Act

In the wake of globalisation, we have witnessed the rise of the transnational corporation—powerful, new players in an international human rights system ill-equipped to handle the challenge. Despite the best efforts of the United Nations, international treaties and human rights lawyers the world over, there is simply no mandatory international code of corporate conduct targeting human rights practices. Enter the Alien Tort Claims Act (ATCA), a once-obscure U.S. statute that provides a private cause of action for violations of international human rights law committed by governmental and non-governmental actors. This paper will examine recent ATCA jurisprudence, the landmark Unocal settlement, and the ATCA’s role in reining in Yahoo! Inc. for supplying evidence used to convict Chinese dissidents Wang Xiaoning and Shi Tao.

Getting to Peace? Negotiating with the LRA in Northern Uganda

Getting to peace is not a straightforward process. In Uganda, internal conflict has raged for more than 20 years between the Government and the Lord’s Resistance Army. The construction of a comprehensive negotiated settlement is at the mercy of conflicting ideologies and influences at the international, national and grassroots levels. This paper examines the Juba peace talks, the major actors in the negotiation process, and tension between prosecution and amnesty.

The Incongruities of Grutter

This article scrutinizes the inconsistencies in the 2003 Grutter v. Bollinger Supreme Court decision which upheld the University of Michigan’s law school affirmative action policy. The decision, which now governs university admissions policies in all 50 states, ruled that “diversity” remains a compelling state interest that legally justifies discriminating between individuals on the basis of their race in determining college admissions. This article examines two incongruous justifications offered by the Grutter court in justification for their ruling: the “critical mass” justification and the no “undo harm” argument. Neither rationale is able to withstand careful, logical examination.

The Most Unique of all Unique Species

This article identifies the shortcomings of “orthodox neo-Darwinians” such as Richard Dawkins, George Williams and Daniel Dennett in their efforts to describe human nature and human pro-social behavior. As an alternative to the views of these thinkers, the efforts of Peter Richerson, Robert Boyd, and other “dual inheritance” theorists to describe the evolution of human nature are also characterized. It is argued that dual inheritance theorists have surpassed the orthodox neo-Darwinians in their explanations for very important and uniquely human features such as our extensive sociability, complex cumulative culture and morality.

The Abolition of the Death Penalty in Rwanda

This paper argues that Rwanda’s decision to abolish the death penalty should be viewed in a wider context rather than as a mere result of top–down pressure from the International Criminal Tribunal for Rwanda (ICTR). Part I traces the creation of the ICTR and the breakdown of negotiations as a result of the exclusion of the death penalty from the ICTR’s jurisdiction. It then outlines Rwanda’s efforts to prosecute the hundreds of thousands of individuals accused of committing genocide-related crimes and notes the limited and steadily decreasing role the death penalty actually played within Rwanda. Part II discusses Rwanda’s legislation abolishing the death penalty and argues that both international pressure and local historical and political forces influenced the decision. Part III situates Rwanda’s story within a growing paradox of excluding the death penalty from international criminal tribunals for the most serious crimes while national jurisdictions maintain it. It concludes that as in Rwanda, any perceived or potential impact of international criminal law in national jurisdictions must be measured in light of local circumstances.

Justice: Plain Old and Distributive: Rejoinder to Charles Taylor

This paper argues that the views of Charles Taylor on justice in income and wealth distribution are fallacious, especially in regard to issues such as private property rights, justice, human rights, and theft. As to this last point, Taylor maintains it is possible, under certain circumstances, to “legitimately steal.” We regard this as a philosophical howler of the first order. We also demur from his contention that equity and equality can be used as synonyms.

Tourism has long figured in municipal and state-wide plans for economic development and revitalization. Such plans often articulate themes subsequently used to organize tours, advertising campaigns, and merchandising. In the 1990s, some residents of Roswell, New Mexico, tried to build tourism using typical southwestern themes. Others capitalized on Roswell’s unique association with an alleged crash of an extraterrestrial craft. Early support from the New Mexico Tourism Department (NMTD) facilitated the success of Roswell’s UFO-based tourism. In 2007, NMTD launched its own alien-based advertising campaign promoting New Mexico as a tourist destination.

Strengthening a demoralized and nearly dysfunctional State Department by acknowledging the vital role foreign area experts must play will have to be a major part of the new administration’s policy.

The “L-Word,” or Turning Fifty

This meditative essay by a writer and professor reflects on the milestone of reaching 50 years of age. The author relates his own experiences and those of his elder literary friends and colleagues who have felt comparable anxieties and coped with similar challenges toward aging and death. He records their own milestones on life’s journey as well as their insightful and often quite hopeful, if not always cheery, responses. Several of them, like the author, admit that turning 50 has entailed for them a coming to terms with the impossibility of realizing some immortality projects.
