Restorative justice, rooted in the practices of indigenous people across the globe, has grown exponentially in both theory and practice since its beginnings in Canada in the 1970s. Restorative justice has influenced the interactions between offenders and victims, helped community members address crime and develop self-efficacy, and changed the way some countries rebuild after a history of oppression. Despite these restorative justice influenced changes, many criminology and criminal justice programs pay scant attention to restorative justice in curricula. This paper will examine ways to include restorative justice in criminal justice and criminology curriculum and the challenges involved in the process. The paper will then examine how the Law and Justice Department at Central Washington University has incrementally added restorative justice components to its curriculum, culminating most recently with the addition of a Community and Social Justice course. The paper will conclude with several examples of classroom activities and assignments that have helped connect students with the theory and practice of restorative justice.  相似文献

Despite the encouraging results of public opinion assessments on restorative justice, people are not likely to spontaneously suggest restorative measures after a crime. Restorative justice thus seems in need of a public relations strategy. This paper discusses the strategy labeling victims as the universal remedy to promote restorative justice, and the proposal of promoting restorative justice through the media by foregrounding crime victims in media reports on crime. This strategy stems from a belief that the most appealing aspect of restorative justice to the public is its thoughtfulness to victims. However, I will argue that there are three problems with this approach. These concern: (1) the victim’s position in both restorative justice theory and practice; (2) the characteristics of media reporting on crime in general and victims in particular; and (3) the risk of attaining a result opposite to the initial objective (i.e. increasing punitive attitudes instead of promoting restorative justice).  相似文献

Psychological responses to criminal wrongdoing have primarily focused on the offender, particularly on how (and why) offender punishment satisfies people’s need for justice. However, the restoration of the victim presents another way in which the “psychological itch” that injustice creates can be addressed. In the present article, I discuss two lay theories of how crime victims can be restored: a belief that the harm caused to crime victims should be directly repaired (a restorative justice approach) versus a belief that victim harm should be addressed via the punishment of the offender (a retributive justice approach). These two lay theories are discussed with regard to their emotional and ideological determinants, as well as situational and chronic factors that can affect whether people adopt a reparative or punitive “justice mindset” in dealing with victim concerns (and crime in general).  相似文献

Nearly two hours after the September 11 terrorist attacks, a hate crime was committed against the Islamic Cultural Center in Eugene, Oregon. Rather than following the conventional criminal justice process, the director of the center and his wife chose to engage in a process of restorative dialogue with other community members and the offender himself. This case study of moving from hatred to healing occurred in the larger context of restorative justice, a movement that is now developing in many hundreds of communities in more than 17 countries. Social workers committed to community practice have played an active role in this reform movement, which has developed over the past two decades.  相似文献

We investigated the hypothesis that people's need for punishment does not preclude a desire for restorative sanctions that address the repairing of the harm to victims and communities caused by wrongdoing. Study 1 showed that although people felt it was important to punish the offender to achieve justice, they viewed additional justice goals as equally necessary. Study 2 revealed that people viewed sanctions as differentially able to fulfill various justice goals. Study 3 showed that the target on which respondents focused—the offender, victim, or community—determined which sanctions they selected to achieve justice; and that people did tend, by default, to focus on punishing the offender when responding to crime. These findings, taken together, suggest that people view the satisfaction of multiple justice goals as an appropriate and just response to wrongdoing, which allows for a possible reconciliation between the "conflicting" goals of restorative and retributive justice.  相似文献

In this article we present, discuss and try to evaluate initiatives which were recently introduced into the Belgian criminal justice system, aimed at the development of creative answers to crime that avoid the use of traditional prison sentences. We decided to focus this analysis on the practice of mediation as it is actually considered the most innovative approach to the crime problem. Mediation as a problem-solving intervention has to be considered in direct relation to the discussion of the purpose of the criminal justice system. By putting the emphasis on the dialogue between the victim and the offender, a common solution is worked out with the help of a mediator. In this way reparation, redress and sometimes even reconciliation become core values of the penal action.  相似文献

Despite the importance of facilitators, staff, and volunteers to restorative justice programs, we know very little about what they think about the goals of restorative justice. This paper fills that gap by reporting the findings of a survey of restorative justice practitioners in Nova Scotia, Canada. Participants rated the importance of 29 justice-related goals such as punishment and accountability. The results show how respondents distinguish between, prioritize, and balance competing justice goals. A factor analysis shows how goals cluster together revealing more depth about how practitioners understand goals, such as accountability, that have different meanings depending on the context. The findings are particularly interesting because the restorative justice program in Nova Scotia is deeply embedded in the criminal justice system. The findings speak to concerns about whether programs rooted in the mainstream system risk being diluted by dominant criminal justice system discourses. I conclude that restorative justice practitioners can prioritize the values of restorative justice in a program that is deeply rooted in the mainstream criminal justice system.  相似文献

恢复性司法是一种通过恢复性程序实现恢复性后果的非正式犯罪处理方法。为考察司法人员与公众对待确定未成年人恢复性司法制度态度,对法官、公众等不同群体作问卷调查,结果表明,法官和公众对未成年人司法制度的诸项改革基本认可。该制度的合理性表现在可减少刑事污点对未成年人的消极影响,有利于恢复受损的社会关系,对违法犯罪的未成年人有积极的矫正作用;其局限性体现在难以满足同罪同罚的刑法原则,难以避免替代性的承担责任的现象等。避免局限性的关键在于要解决恢复性司法与正式司法程序的关系问题。  相似文献

Contemporary and alternative justice paradigms lead to definitions of wrongdoing as "lawbreaking" and "harm to social relationships" respectively. The retributive model within the contemporary justice paradigm results in strategies to accomplish justice that focus almost exclusively on the wrongdoer. In contrast, the restorative model within the alternative justice paradigm yields justice practices that focus on the relationships among all individuals harmed by the wrongdoing. Calgary Community Conferencing is an example of a restorative approach to wrongdoing. The relational emphasis of this program is operationalized through its organizational location, intended outcomes, and program activities. The challenges faced by Calgary Community Conferencing provide other agencies with ideas about dilemmas they might encounter in attempting to develop restorative justice programs.  相似文献

Restorative justice is currently practiced in a variety of ways inside correctional facilities. One such way is the facilitation of restorative justice education. If grounded in restorative values, such education can contribute to outcomes similar to other restorative practices, such as victim offender dialogue. These outcomes include opportunities to speak to personal experiences, personal change, and growth, and a desire to engage in positive relationships and give back to the community. This paper draws on the teaching and facilitation experiences of the author and incarcerated peer facilitators to develop a restorative justice pedagogy. This pedagogy, based on restorative values, aims to inspire individual and social transformation; build community among participants; give voice to the unique experiences of participants; offer opportunities for real-life problem solving; provide a creative learning environment that is co-created by students and facilitators; view students as practitioners, theorists, and educators; and invite instructors to view themselves as students and share in the learning process. Implications of the restorative justice pedagogy for teaching outside the prison context and with course material other than restorative justice conclude the article.  相似文献

In addition to the more conventional approaches of the criminal justice system, this article suggests that there is a need for restorative justice as another method of addressing sexual crime. In support of this view, the present article explores the possibility of a hybrid justice system based on a complementary relationship between restorative justice and the criminal justice system. An analysis of the limits of the criminal justice system and the need for restorative justice in the contentious area of sexual crime will be followed by a detailed examination of key justice considerations when trying to marry both criminal justice and restorative justice perspectives. Such considerations include: the meaning of justice; legislation; sentencing principles; due process; victims’ rights; and the location of restorative justice within/alongside/outside the criminal justice system. The aim of this article is to determine whether it is possible to reconcile two seemingly juxtaposed methods of justice delivery in the context of sexual crime in order to create a hybrid system of justice that best protects and responds to the rights and needs of victims and offenders.  相似文献

Within contemporary society, there is a prevailing sentiment that our criminal justice system leaves much to be desired in its responses to the offender, the victim, and the community. As a potential answer to these conceded shortcomings, restorative justice has earned significant recognition and consideration. While restorative justice principles and programs have received increasing support, for many individuals this is limited to cases involving relatively ‘minor,’ first time, and/or juvenile offenses. When it comes to situations with more ‘serious’ and violent offenses, acceptance of restorative responses dissipates. Gaining broader acceptance can be particularly challenging with current college students. With many students raised in the ‘get tough on crime’ era, embracing this alternative approach to serious crimes can be a difficult paradigm shift. This article will provide a framework for approaching the feasibility of applying restorative justice with serious offenses in the college course. In addition, suggestions for readings, projects, and assignments that will further assist in effectively engaging students with these issues will be provided.  相似文献

Youth crime is an ongoing concern in Australia. Victims, offenders and the community are all affected by crime and the current criminal justice approach seems both ineffective and inefficient. Restorative justice proponents have posited that their approach to justice through dialogue and negotiation in the conferencing process may be more effective than the traditional retributive justice. Restorative justice conferencing for young offenders is not, however, unfaultable in its ability to reduce the harm caused by crime or to reduce recidivism. The main focus of conferencing has been on the outcomes with limited attention paid to the process and its impact on a young offender’s sense of wrongdoing and remorse. There has been limited research undertaken into the oral competencies of young offenders in relation to their performance in conferencing, and equally limited studies on the specific use of language by facilitators. Other research has shown a coexistence of youth offending and developmental language and learning disabilities. The secondary study discussed in this paper reveals the language difficulties encountered by young offenders in the conferencing process. It is recommended that in order for young offenders to understand what they have been asked, to reflect on it, to express their thoughts and feelings, and for behavioural change to occur, the communication, both verbal and non-verbal, must be unambiguous, comprehensible and pitched at their individual demographic. More research is required into language use by conference facilitators and its impact on young offenders.  相似文献

囿于传统行刑模式的弊端,实践为摆脱困境而自发产生的恢复性行刑展示了其积极的沟通、整合与效率功能。恢复性行刑模式以有益互动为核心,以平等为基础,将服刑人员与管理者、被害人、社区及其他社会参与者带入协商对话的平台。服刑人员在与他者的互动中降低权威者给予的耻辱烙印,获得被害人及社会人员的的原谅认同,最终实现身体与心理的回归,消除犯罪的印记,体现出较强的去标签化功能与提升犯罪控制的功能。恢复性行刑的实现方式则彰显出其潜在功能——传承并超越于传统正义,实现了互利正义。  相似文献

The restorative justice movement has great potential to reform the way society responds to crime and wrongdoing. One might logically assume that the greatest challenge to the new restorative justice paradigm is the traditional punitive criminal justice paradigm itself. A more immediate threat, however, is posed by merging community justice, another approach to reforming the justice system, with restorative justice. Community justice has superficial similarities to restorative justice but relies on the underlying authoritarian assumptions of the existing criminal justice system and on processes that exclude most of those individuals directly affected by the offense. This paper clarifies and contrasts the key elements of both the restorative justice and the community justice paradigms and explains the threat to restorative justice posed by combining and confusing the two.  相似文献

恢复性司法缘起于上世纪70年代的刑事司法实践,并逐渐成为影响传统刑事司法的重要司法范式。恢复性司法是在反思传统司法的基础上产生、发展起来的。可以弥补传统刑事司法过于对抗、忽视被害人等缺陷,从而迅速风靡于西方国家。我国无论是文化观念,还是刑事司法制度与实践,都存在着契合于恢复性司法的因素。刑事司法制度的完善,有必要吸收恢复性司法的理念,结合我国刑事司法的本土资源,建立恢复性司法制度。  相似文献

平和司法是在学习国外恢复性司法理念、实证分析烟台市检察机关的办案实践、考察外地检察机关的先进经验的基础上提出的全新命题,是恢复性司法本土化的一个尝试。平和司法可分为司法心态(基础要素)、司法模式(手段要素)、司法境界(目的要素)三个层面,与恢复性司法最大的不同就在于它的层次性和层次之间的互动性。平和司法在执法理念上与传统的司法理念有很大的转变,与宽严相济的刑事政策相适应,符合社会主义法治理念的本质要求。实践平和司法将对维护社会和谐稳定、预防犯罪、节约司法资源、维护被害人和犯罪人合法权益具有积极意义。  相似文献
