论我国社会保障立法的价值取向

社会保障立法的价值取向是设计社会保障制度的前提。考察我国以往社会保障的改革历程和立法现状 ,就会发现社会保障立法的价值取向与经济政策和经济立法的价值取向日益混为一体 ,这也是社会保障立法滞后的深层原因。社会保障的功能和我国经济发展的实际情况 ,决定了社会保障立法应把维护社会成员的生活秩序和整个社会的秩序作为首要的和根本的价值取向 ;同时 ,要通过社会保障立法 ,建立为了满足以社会公平为目标的社会机制 ,并通过对国民收入的再分配实现一种相对的社会公平 ,以此促进经济效率的提高     

以社会救助法构筑和谐社会的最低门槛

社会救助法是社会法体系中首要和前提立法,是社会保障的最后一道门槛,是公民生存权的最后保障。社会救助立法要立足社会法角度定位其价值取向和内容体系。     

社会保障法及其相关概念辨析

社会保障法的相关概念主要有 :社会保障法学、社会保障学、社会保障制度、社会保障、社会福利、社会工作和社会政策。社会保障制度与社会保障法律制度是不同的概念 ,两者是属概念和种概念的关系 ,社会保障法律制度是社会保障制度的组成部分。社会保障法学与社会保障学是种概念与属概念的关系 ,社会保障法学是社会保障学与法学的交集 ;社会保障法学属于研究社会保障的学科之一。广义社会保障与狭义社会福利的关系是属概念与种概念的关系 ,与广义社会福利是同义词 ;社会保障与社会政策和社会工作是交叉概念 ,社会政策与社会工作是以社会问题为对象的并列概念。

一、农村社会保障体制建设的概念界定 (一)农村社会保障的概念 社会保障(social security)一词原意为"社会安全",最初出自 美国1935年颁布的《社会保障法》,主要是指国家以立法和行政措 施确立对遇到疾病、伤残、生育、年老、死亡、失业、灾害或其它风险 的社会成员给予相应的经济、物质和服务的帮助,以保障其基本生 活需要的一种社会经济福利制度。完全的社会保障的对象为全体 社会成员,包括城镇职工和农村居民。农村社会保障是相对于城镇 社会保障而言的一个概念,是社会保障的重要组成部分。由于人们 对社会保障内涵的认识存在较大差异,给农村社会保障的概念界 定造成困难和模糊,至今,人们对农村社会保障概念还没有-个统     

关于我国社会保险立法若干问题的探讨

一、社会保险立法的必要性和紧迫性我国的社会保障体系包括社会保险、社会福利、优抚安置、社会救助和住房保障等。它适用于全体社会成员，目的在于保证劳动者和其他社会成员以及特殊社会群体成员的基本生活并逐步提高其生活质量。其中社会保险的内容在社会保障中所占比重最大，可谓社会保障体系的核心。社会保险具体包括养老保险、失业保险、医疗保险、工伤保险和生育保险等重要内容。从功能上来说，社会保险制度被还称为经济发展的“减震器”和“助推器”。     

为了人民依靠人民

为人民而改革,是改革的价值取向。改革开放30多年,我国人民群众得到实惠最多、生活水平提高最快、城乡居民生活由温饱不足到总体小康再向全面小康迈进,社会保障从低水平到建立制度框架再到全覆盖。可以说,没有改革开放,就没有中国人民今天的美好生活。

中央提出构建社会主义和谐社会对中国特色社会保障制度的创新和发展提出了更高要求,使社会保障制度发展要求、价值取向更加明确。维护社会公平是构建社会主义和谐社会中的社会保障制度的核心内容,必须坚持科学发展观,坚持共同富裕的发展方向,坚持正确的公平观和分配原则,坚持继承与创新相结合,从促进人的全面发展总体布局出发设计公平合理的社会保障制度,以促进社会和谐。     

关于中国社会管理体制改革的几个基本问题的认识

社会管理主要是政府和社会组织为促进社会系统协调运转,对社会系统的组成部分、社会生活的不同领域以及社会发展的各个环节进行组织、协调、服务、监督和控制的过程。中国的社会管理体制改革有一个历史的发展过程,也有自身的价值取向与目标原则。我们需要在借鉴的基础上,建立符合社会发展需求的变革体制框架,这一框架包括树立社会管理体制变革的价值观,以建立政府主导、社会协同的社会管理新格局为核心,以建立有效的社会保障制度为重点,以实现社会管理机制的创新为目标。
