“坐牢补偿费”的法律定性及司法规制

给予和收受"坐牢补偿费"是对法律秩序和司法制度的挑战和冲击。它削弱了刑罚威慑力和司法公信力;作为一种新的腐败动向,它降低贪官腐败成本,影响整个惩贪治腐进程;它助长了"行业潜规则"肆意横行,严重败坏社会风气,混淆了正义标准。基于目前学术界和实务界对"坐牢补偿费"的期权腐败、继续犯罪、补偿赠与等法律定性问题,建立结构合理、制约有效的权力运行机制和事前反腐机制,加强对行贿人的打击力度及惩治力度,完善行贿罪的立法势在必行。     

中国语境下的媒介审判———以程序正义为视角简

媒体介入刑事审判更多地是对审判独立形成了一种干预,社会舆论的日益自由化和一定程度的不可控性,极易引起党政机关领导及国家司法行政机关的关注,转而对法官依照事实和法律独立地形成心证作出裁断产生干扰.但不可否认的是,媒介审判以其刚性的表征客观上也起到了其本质上监督审判运行的作用,对于现阶段完善我国的审判监督机制具有着某种意义上的积极作用.     

The Tunisian Revolt: Learning from the Mistakes of the Iranian Revolution

The Great Arab Revolt of 2011 has moved swiftly from the peaceful overthrow of autocrats in the nation‐states of Tunisia and Egypt to brutal repression in the tribal societies of Libya, Syria, Bahrain and Yemen. Meanwhile, the wired youth bulge of the Middle East that brought change is dissipating into an impotent diaspora while the organized interests of the old regimes and the once‐suppressed Islamists charge ahead to power. This section examines the revolt, the reaction and the power struggles in its aftermath.

Disarmament,with special reference to Asia

On February 20 M. V. dc Korostovetz read a paper on Soviet Russia and her Southern Neighbours. The subject was divided into four parts: (a) The general trend of Russia's foreign policy, which, whether Imperial or Bolshevik, has differed in method rather than aim; (b) the States from Turkey to China, lying to the south of the Soviet block, with special attention to Chinese Turkestan; (c) the Ukrainian attitude to Communism; and (d) an outline of the new canals planned to make the Volga the chief waterway of Russia at the expense of the Don, and, with the refortification of the Straits, to turn the Black Sea into a mare clausum.     

“晕轮效应”对考录公务员面试考官的影响与应对

"晕轮效应"是一种主观心理臆测,是一个不可忽视、又无处不在的评价偏见,具有片面性、表面性和弥散性的特点。它存在于考官队伍中,对公务员的选拔工作会造成负面影响。"晕轮效应"作为一种心理现象,在公务员的面试过程中是不可消除的,因此,应该从主观上主动地去避免、克制,并且还要建立严格的选人用人制度,在客观上防止"晕轮效应"的出现,使"晕轮效应"的影响降到最低程度,保证面试的科学性和可靠性,努力做到公平、公开、公正地选拔人才,求得面试的效果最佳。

This study applies Elisabeth Noelle‐Neumann's spiral of silence theory to the controversial issue of whether children with AIDS should be allowed to attend public school. The study tests the theory's hypotheses in light of two content analyses of the media's treatment of the issue. The findings offer tentative and qualified support for Noelle‐Neumann's theoretical propositions about the relationship between individuals' perceptions of the issue and the media's tenor of the issue; particularly that of television. The findings suggest the need to address the role of other agents of influence, including reference groups, and to use time‐based data to unravel the causal order of the relationships.
