在现行刑事案件管辖制度的基础上,网络犯罪管辖权应进一步细化联结点并确立优先次序.不同类型的网络犯罪在管辖权设定上的关注点应有所不同.网络犯罪案件的管辖应当遵循实体法与程序法相一致、案件的全面覆盖与均衡分布、便利性等价值追求.以实施网络犯罪行为的计算机终端所在地为行为地,以受害人发现权利被侵害的计算机终端所在地为犯罪结果发生地,并辅之以被告人住所地,确立一个分层次的网络犯罪司法管辖体系.  相似文献

In this paper some studies with respect to empirical socio-economic research which has been undertaken in Belgium and the Netherlands concerning the functioning of legal rules and institutions are discussed. The paper focuses on the domains of criminal law, civil procedure, liability and insurance. The paper argues that contrary to the overwhelming economic literature on liability and insurance, the empirical results in that domain are poor. More research is undertaken in the area of criminal law and apparently it is overwhelming in the area of civil procedure. The latter studies are, however, mainly undertaken by socio-legal scholars and less by economists. The general conclusion of the empirical studies discussed seems to be that while the empirical literature on the effect of changes in the decision making environment on rational actions in the legal system is rich and provocative, there is much less empirical testing of the effects of legal rules as such on allocational outcomes. The paper argues that much more effort should be devoted to the latter issue.  相似文献

For more than a quarter-century, the Nagorno-Karabakh conflict has been one of the most important factors influencing the political map of the South Caucasus. On 12 May 1994, Nagorno-Karabakh, Armenia, and Azerbaijan signed a cease-fire agreement that ended military operations in the conflict zone and has been observed until recently. Negotiations for a peaceful settlement have been underway within the framework of the Organization for Security and Co-operation in Europe Minsk Group co-chaired by the USA, Russia, and France since 1992, but society and the elite in Armenia, Nagorno-Karabakh, and Azerbaijan remain largely unprepared for compromise. Considering the settlement process a zero-sum game, they have generally accused one another of escalating the conflict and of a lack of willingness to restore peace. Other countries and international organizations involved in the negotiations do not share a vision of the future and frequently pursue their own interests. Accordingly, the Karabakh conflict could remain unresolved for decades more. The aim of the paper is a general assessment of the current stage and dynamic of this conflict and the impact of new trends and old obstacles on the prospects for further settlement.  相似文献

作为世界上情报体系最为发达的国家,美国国家安全情报机制一直以来备受各方关注。九一一事件催生了美国情报体系全面而彻底的改革。经过十多年的努力,美国情报界实现了从机构林立的分散体系到由国家情报总监办公室领导的有机整体的重大转型。从总体机制来看,美国情报界现已形成情报机构一体化与任务一体化的双轮驱动体系,其情报传递网络不仅涵盖领导、协调、执行三个层级间的纵向传送,而且包括不同情报机构之间的横向协调,基本实现了情报整合与信息共享。美国国家情报总监办公室成为名副其实的美国情报界统领,其下设的反恐、反扩散、反情报和网络情报中心构成了美国国家安全情报分类传递机制的四大支柱。通过比较,四大分类传递机制中最为成熟的是反恐中心,其次是反情报与安全中心,再次是网络威胁情报整合中心,最后是反扩散中心。由于各类情报机制自身发展程度的不同,其改革过程中所面临的挑战也不一样。美国国家安全情报传递机制的改革“瓶颈”既有发展不足导致的结构性困境,也有外部安全环境变化带来的挑战。此外,特朗普政府上台后的一系列政策举措使得美国国家安全情报体系的发展方向呈现出新的态势。  相似文献

The global proliferation of precision-strike systems may be challenging the foundations of Western military-technological supremacy. Relatedly, the development of so-called Anti-Access and Area Denial (A2/AD) capabilities across the globe threatens to complicate Western freedom of military movement and access, and could give way to a more contested military-strategic environment. The twin challenges of precision-strike proliferation and A2/AD strongly impact NATO’s agenda, which revolves around strengthening deterrence and defence in Eastern Europe, and addressing the different threats emanating from the so-called Southern European neighbourhood. In order to address or mitigate such challenges, the Alliance needs to produce operational concepts and capabilities able to deliver deterrence and expeditionary warfare in a maturing precision-strike environment, one characterised by the emergence of A2/AD capabilities.  相似文献

This research makes use of factor analysis to locate important dimensions of individual differences in perceptions of legal punishments. A sample of 152 recently arrested persons provided magnitude estimates of the seriousness of several types and levels of punishment. A factor analysis of the data showed that the major dimensions of individual differentiation were in responses to (a) lengthy periods of imprisonment; (b) several punishments judged less serious, including short periods in jail or on probation; and (c) fines. Regressions of the factor scores on individual characteristics are reported, and the implications of the analysis for deterrence theory are discussed.  相似文献

This study integrated two methodologies, the vignette‐based survey and the randomized laboratory experiment, to investigate the relationship between projected and actual offending behavior. Findings indicate that respondents' estimates of the likelihood they would drive drunk in a hypothetical vignette were positively correlated with whether they simultaneously cheated on a laboratory task to earn a cash bonus. Implications are discussed for both the prospective measurement and heterotypic continuity of criminal and antisocial behavior.  相似文献
