个人信息权和个人信息受保护权是两种相对立的模式,学界通常认为个人信息权赋予个人排他性的支配权,这与个人信息的公共性相矛盾。个人信息的公共性并不必然反对权利模式。一种广义的公共性包含着个人信息所负载的公共利益,个人信息的公开化也是网络时代个人和商业交往的必要前提,但这并不意味着要否定个人信息保护的权利模式。公共利益具有多样性,正是某些公共利益支持了权利。权利所蕴涵的主张权确保了人的尊严和自由,这也是个人信息保护法的立法宗旨;个人信息受保护权做不到这一点,它不具有义务指向性。但在立法模式上,个人信息保护法要以义务性规范或禁止性规范为主,这是由网络空间个人信息的性质决定的。  相似文献

在"法院调取通话记录""交警查手机"等实践争议引导下,学者们借助基本权利限制的"保护范围—限制—限制的合宪性论证"的审查框架,推进了通信权的宪法释义。但将通话记录排除出通信权的保护范围,并不能有效解决实践难题,且因为过早窄化保护范围而会影响基本权利的保护效果。诉诸隐私权或者个人信息权的方案亦难以成立。应认识到《宪法》第40条存在因制宪者预见不足而产生的宪法漏洞。如果将"检查通信"理解为"示例性规定",则《宪法》第40条容有对通信权限制的其他可能性。在"通信内容"和"非内容的通信信息"分层构造下,可以建立起既能回应生活事实和实践争议,又能落实宪法严格保护目标的教义学体系和审查框架。基本权利个论的研究,有助于反思基本权利保护范围的"宽界定"或"窄界定",以及法律保留体系的普适性等基本权利总论问题。  相似文献

《个人信息保护法》是数字时代个人信息保护的基本法。它采取了将个人信息权作为新兴公法权利的思路,确立了完整的个人信息权利保护体系,在个人信息保护问题上和《民法典》一起形成了公私法共同协力的进路。《个人信息保护法》以权利束的方式规定了个人信息主体的知情权、决定权、查阅权、复制权、更正权、删除权、可携带权和信息权利救济权等。《个人信息保护法》从立法依据、权利体系、条文设计和规制措施上都体现出鲜明的公法属性,这也可以从基本权利的双重面向和个人信息国家保护义务得到理论上的证成。这部法律是数字时代公法秩序的基石,它对公法边界的形塑仍需通过其实施来确立。  相似文献

《个人信息保护法》最终纳入“根据宪法”条款,表征着个人信息保护法律体系在底层逻辑上的更动。民法学上权利与利益的区分保护原理,难以适用于整个合宪性法秩序。应将个人信息权确立为宪法位阶的基本权利,并以基本权利作为针对国家的主观防御权和辐射一切法领域的客观价值秩序的原理,协调个人信息保护的私法机制和公法机制。通过对人权条款笼罩下的通信权和人格尊严条款的解释,可以在学理上证立“基本权利束”性质的个人信息权。但其具体保护则应分别归入不同基本权利条款,作出区分化、差异化的多层次构造。个人信息保护的支配权思维有其局限,告知同意模式的式微是重要表现。应将个人信息权的规范目标调整为人格的自由发展,指向免于他人的人格干预。从支配权到人格发展权的思维转换,有助于规制对已收集信息的不当利用、破除“信息茧房”、缓和个人信息保护与利用之间的紧张,以及在“个人—平台—国家”的三方关系中有效保护个人的自决,同时为数据产业保留发展空间。  相似文献

商业组织在全球范围内使用数据获得法律保护是数据经济进一步发展的基石。对数据使用的知识产权保护意味着保护“数据”的各种外在呈现形式,尤其是数据集合。数据经营者对数据经济的贡献、数据主权和数字人权带来的现实障碍提出了迫切要求。以德国、美国和日本为代表的主要国家对数据使用保护进行的知识产权立法为数据跨境流动相关制度研究提供了基础。世界贸易组织、世界知识产权组织以及欧盟对数据使用提供了现实保护,但是现有国际法律制度无法对大量存在的非独创性数据集合提供充分保护。其原因包括各国发展水平不一致、数据主权和个人数据保护受到更多关注、国际法碎片化发展趋势等。对此,应在数据相关制度和实践中坚持促进数据使用为指导原则;在TRIPs体系内构建非独创性数据集合制度,该制度在保护数据集合专有权的同时应注重平衡个人数据保护、数据主权和公众信息获取权。立足中国参与全球数据治理现状,中国应在著作权法体系下构建非独创性数据集合有限排他权,并完善相关立法和实施以促进跨境数据流动。  相似文献

个人数据权益的多元性,决定了个人数据在不同场景中的权属不同,这意味着对不同权属性质的个人数据,提供的法律保护模式也不同。我国对个人数据的法律保护模式有三种:财产权保护模式、人格权保护模式和平台保护模式。鉴于当前我国数据确权的制度安排尚未完成、数据的人格权保护没有得到公益救济、数据利益的损害赔偿无法实现,有必要对不同权属性质的个人数据作出有针对性的调整方案:在方法论上应突破私法或公法的思维局限,在立法论与数据应用实践层面,对现有的个人数据保护模式作出相应的调整,通过商业秘密保护模式拓宽数据财产权的保护路径,利用个人数据场景化保护模式弥补人格权保护模式的虚置,利用平台保护模式优化数据安全法律保护的制度设计。  相似文献

The right to data portability is one of the most important novelties within the EU General Data Protection Regulation, both in terms of warranting control rights to data subjects and in terms of being found at the intersection between data protection and other fields of law (competition law, intellectual property, consumer protection, etc.). It constitutes, thus, a valuable case of development and diffusion of effective user-centric privacy enhancing technologies and a first tool to allow individuals to enjoy the immaterial wealth of their personal data in the data economy. Indeed, a free portability of personal data from one controller to another can be a strong tool for data subjects in order to foster competition of digital services and interoperability of platforms and in order to enhance controllership of individuals on their own data. However, the adopted formulation of the right to data portability in the GDPR could benefit from further clarification: several interpretations are possible, particularly with regard to the object of the right and its interrelation with other rights, potentially leading to additional challenges within its technical implementation. The aim of this article is to propose a first systematic interpretation of this new right, by suggesting a pragmatic and extensive approach, particularly taking advantage as much as possible of the interrelationship that this new legal provision can have with regard to the Digital Single Market and the fundamental rights of digital users. In sum, the right to data portability can be approximated under two different perspectives: the minimalist approach (the adieu scenario) and the empowering approach (the fusing scenario), which the authors consider highly preferable.  相似文献

个人信息在《民法典》中被确认为一种人格法益,在理论和立法上确立了我国个人信息的私法保护面向。个人权益保护成为构建和理解个人信息保护的重要维度和线索。由于个人信息保护的公共目标和功能可能被个人私益保护的进路所覆盖或消解,因此有必要将社会风险控制作为个人信息保护的重要维度来对待。社会风险控制一直是电子化时代个人数据保护的基础性目的,它对于个人信息保护的相关理论和制度具有很强的解释力和动态构建作用。社会风险控制和个人权益保护两种进路在相关基础问题上出现分歧,如个人信息与隐私的基础关系、一般性保护与场景化保护以及本权与保护权的关系等。在《个人信息保护法》实施过程中,社会风险控制进路有助于合理解读和执行法律,把握风险大小与控制措施的合理匹配,以及在平衡相关立法价值的前提下,释放信息的流动性。  相似文献

This paper explores and critically reflects on the legal foundations and the practice of criminal defense in Ethiopia within the overall due process framework of a fair criminal trial. A brief review of Ethiopian constitutional history shows that the right to representation by legal counsel has been one of the fundamental due process rights granted to accused persons in criminal proceedings. The constitutional right to counsel is, however, not specified by detailed legal provisions. A logical consequence of this is that the enjoyment of this right is fraught with legal and practical problems. While the legal problems, among other things, include obscurity regarding the scope and content of the right, the practical problems include absence of public defense offices at district levels where the vast majority of criminal proceedings take place. Consequently, accused persons appear during trials without the aid of legal counsel; they are in fact deprived of their due process rights and marginalized. This has a number of legal ramifications both to the accused and the criminal justice system. In sum, the constitutional provision of the right to criminal defense counsel is undelivered and remains a hollow promise. It is therefore difficult to uphold the constitutional norms which underlie criminal trial process such as procedural justice, as well as the legitimacy of the government. The justice sectors are responsible to ensuring due process and equal protection. Substantial justice reforms are needed at all levels.  相似文献

Personal information protection and privacy interact in diverse ways, especially in the contemporary information age. Although books and articles have focused on this topic, the new tendencies of worldwide legislation and judicial practice bring challenges, as the legal construction of personal information protection and privacy differs from culture to culture and time to time. In 2017, the General Provisions of the Civil Law of the People's Republic of China (“the General Provisions of the Chinese Civil Code” hereafter)1 (expired) addresses the legal concepts of personal information protection and the right to privacy simultaneously, to which this article refers as the dual model, differing from the one-dimensional mode of privacy protection before. Subsequently, the “The Right to Privacy and the Protection of Personal Information,” a chapter of the newly issued Civil Code of the People's Republic of China's (“the Chinese Civil Code” hereafter), ascertains the dual model and details related provisions. It has been dubbed a landmark ruling of China's personal information protection, greatly boosting the modernization of China's civil system.Despite the many articles that discuss approaches to China's civil protections, little attention has been given to the fundamental question concerning what exactly encompasses the personal information protection and privacy to which these laws refer. Based on the regulations and applicability of the General Provisions of the Chinese Civil Code and the Chinese Civil Code, this paper explores the legal construction of personal information protection and privacy under Chinese legal orders, including the differences, similarities, and interplay between the two rights. By distinguishing the legal value, contents and remedial approaches, this paper concludes that the two rights are distinct but overlap. On one side, personal information protection is elevated to the status of a separate civil right in the legal context of China, rather than part of privacy. On the other side, tailored regulations should be establish according to the criteria of the nature of information, the extent of information processing, and the elements of damage when confronted with overlaps in the two rights in judicial practice. Thus, this paper provides a perspective from which to clarify the approaches to civil protection of personal information and privacy in China and a reference model for enactment of the Chinese Personal Information Protection Law in the future.  相似文献

Artificial Intelligence is spreading fast in our everyday life and the world of work is no exception. AI is increasingly shaping the employment context: such emerging areas are augmented and automated decision-making. As AI-based decision-making is fuelled by personal data, compliance with data protection frameworks is inevitable. Even though automated decision-making is already addressed by the European norms on data protection – especially the GDPR –, their application in the world of work raises specific questions. The paper examines, in the light of the ‘general’ data protection background, what specific data protection challenges are raised in the field of AI-based automated decision-making in the context of employment. As a result of the research, the paper provides a detailed overview on the European legal framework on the data protection aspects of AI-based automated decision-making in the employment context. It identifies the main challenges, such as the applicability of the existing legal framework to the current use-cases and the specific questions relating to the lawful bases in the world of work, and provides guidelines on how to address these challenges.  相似文献

尽管我国民法典以独立成编的方式规定了人格权,但是,由于对人格权的概念存在巨大争议,所以,从民法典人格权编的具体内容和规范来反观人格权的实证概念对于理论研究和司法实践更具有意义。从我国民法典的内容看,我国民法典人格权编实际上包括了两个部分:一是对人格权的保护,二是对人格尊严的保护。隐私权与信息的二元保护就清楚地说明了这一问题。因此,不能认为人格权编中保护的都是人格权。必须把人格权的概念与人格利益区分开来,从而决定其保护程度与救济措施的差别。另外,从表面上看,虽然看起来都是相同的权利(人格权),但是,法人和非法人组织的人格权与自然人的人格权建立在完全不同或者说完全不相关的基础之上--自然人的人格权是以人的自由和尊严为核心的,而法人或者非法人组织的所谓人格权完全是技术处理的结果。当然,这种处理方式也可以通过其他方式处理。荣誉权无论从哪个方面看,都不具有人格权的特征;虽然民法典对其予以了明确规定,但是,荣誉权确实不应该是人身自由和人格尊严的表现,我们在实践中应当将其作为一种特殊权利对待。总之,人格权可以定义为:自然人享有的人之所以为人的主体性权利,包括生命权、身体权、健康权、姓名权、肖像权、名誉权、荣誉权、隐私权等权利,是个人自由、尊严在民法上的具体体现。法人仅仅享有与自由和尊严无关的名称权、荣誉权和名誉权,但法人的名称权、荣誉权和名誉权在实质上不是人格权。  相似文献

商业数据界权包括确定其权利的性质和权利的归属。个人信息保护和数据安全法律体系的建成,为数据界权提供了新的逻辑起点和法律前提。数据界权首先应基于个人信息与数据、商业数据与公共数据等基本范畴的厘清。基于商业数据的固有性质以及工业产权的历史逻辑和制度内涵,商业数据与信息保护类工业产权具有深度的契合性,有必要将商业数据纳入工业产权序列,作为数字时代具有标志意义的一种新型工业产权,并可以成为与商业秘密相对称的商业数据权。商业数据界权需要确定商业数据的适格性--可保护条件。商业数据的适格性包括受保护数据的合法性、集合性、管理性、可公开性和商业价值性,即以合法形成的规模性数据集合为客体,并采取管理措施的可公开性技术数据和经营数据等信息。商业数据具有单一性、复合性和动态性,商业数据权暗含着所涉权利的分层性,其权属界定应当透过现象看本质,将复杂或者貌似复杂的问题简单化,遵循投入原则、分层原则和责任原则等三原则。  相似文献

Vesico Vaginal Fistula (VVF) is a major public health issue affecting women in developing countries, even though it is both preventable and treatable. There is a high prevalence of the ailment and also a large number of untreated victims in Nigeria. Against this background, this examines the factors responsible for obstetric fistulas especially VVF in Nigeria. The author agrees with the prevailing opinion among women’s human rights activists and other stakeholders, that these factors are either a direct violation of human rights, especially of girls and women, or a consequence of the infringement of their human rights. To this end, this work attempts an examination of the international, regional and national legal and human rights frameworks applicable to address VVF. The article highlights that unfortunately there are systemic challenges in the Nigerian legal jurisprudence itself operating as obstacles to the implementation and enforceability of those applicable laws. The work concludes with suggestions to overcome the identified challenges.  相似文献

The processing of personal data across national borders by both governments and the private sector has increased exponentially in recent years, as has the need for legal protections for personal data. This article examines calls for a global legal framework for data protection, and in particular suggestions that have been made in this regard by the International Law Commission and various national data protection authorities. It first examines the scope of a potential legal framework, and proceeds to analyze the status of data protection in international law. The article then considers the various options through which an international framework could be enacted, before drawing some conclusions about the form and scope such a framework could take, the institutions that could coordinate the work on it, and whether the time is ripe for a multinational convention on data protection.  相似文献

传统法律是建立在以人为主体的、以人类利益为中心的理念之上,人的权益是法律保护的核心。在迄今为止的所有法律中,环境始终处于客体的地位。为了人类不被毁灭,就必须放弃人的生存优先于环境系统存在的观念,赋予环境法律上的地位,把创建人与环境同构法作为在法律上解决人与环境问题的终极目标,实现人与环境的最终同构。同构法建立的主要途径,一是要扩展法律主体,赋予环境“法律人”的地位,使其具有主体资格并以平等的地位与人类签订契约;二是完善诉讼参加人制度,通过创建环境诉讼法的方式,让环境作为诉讼当事人或者有独立请求权的“第三人”参加诉讼。  相似文献

气候变化与人权国际保护都是当代国际法的热点问题,全球性、长期性与政治性是二者的共同特征。气候变化对人类社会和自然界的影响是多层次的,而它对人权国际保护的影响涉及国家安全、人道主义问题、发展权、健康权以及国际关系的调整等各个方面。中国作为全球温室气体排放大国,应转变观念,从战略高度重视气候变化问题;同时,还要加强国际合作,重视应对气候变化中的发展权,并加强与气候变化有关的法制建设。  相似文献
