网络犯罪侦查的特点之一就是案件的线索和证据都具有虚拟性的特点,这就导致了取证虽然只是网络犯罪侦查的一个环节,但其作用和涵盖的范围却涵摄侦查的整体过程。网络犯罪侦查取证对象的变迁,电子数据不确定性对手段和目的带来的新要求,以及网络线索扩线的特殊意义,导致了实践中任意性侦查行为与强制性侦查行为相互交融、案外第三人诉讼权利保障缺失等问题。为了回应网络犯罪取证程序的现实困境,应对网络犯罪取证行为进行动态规制,除了严格规制手段和目的外,还应注重程序入口方面比例原则和数据收集最小化原则的适用,以及取证行为的动态规制。

大数据思维下公安侦查取证方式研究——以电子数据取证为视角

现行社会下,网络虚拟世界与传统现实世界交叉融合,许多犯罪分子利用网络犯罪的智能性、隐蔽性的特点手段,实施的"不在场"犯罪日益增多,再借助自己掌握的专业计算机网络知识,在作案过程中或完成后立即使用技术手段抹去有时是破案关键甚至是唯一的电子数据,使公安机关对这类犯罪的取证难度加大,为案件侦破带来较大困难。大数据时代的到来,为侦查工作带来新的变革,转变了侦查思维方式,改变了传统侦查模式,但同时也出现电子数据在收集取证过程中存在的侦查取证手段滞后、侦查人员取证水平不高、侦查协作机制不畅、隐私权保护不力等问题。课题组从不同层级、部门、警种及地区的实地调研出发,深入探讨大数据时代侦查模式的变革,重点阐述侦查取证方式的转变,综合运用综述归纳法、比较分析法、经验总结法等方式并结合工作实际,确立大数据思维的电子数据侦查取证方式,提出遵循电子数据取证原则、健全电子数据取证相关法律法规、树立立体化侦查取证思维、建立专业化电子数据取证队伍、加强隐私权保护力度等对策建议。     

试论信息化背景下的侦查模式转型

信息技术的广泛使用、犯罪的转型、现代犯罪的要求以及保障人权的理念,为侦查模式的转型提供了平台和契机。信息化背景下侦查模式的转变主要体现在:以侦查效率、侦查工作重点和证据收集规则为代表的侦查工作重心的转变,向"数据驱动侦查"、关联性、实时开放的侦查理念的转变,实现多元信息思维、"由人到案"侦查思维的转变,完善以犯罪信息收集机制、犯罪信息分析机制、犯罪信息验证机制、侦查预测机制为主体的侦查运行机制的转变。面对这些转变,侦查主体应该把握侦查模式转变过程中的机遇,迎接挑战,以信息技术为依托,把握侦查的主动性,实现侦查模式转型。

暗网中充斥着贩卖军火、公民个人信息交易、毒品交易等非法活动,打击暗网犯罪对维护社会安全有着重要意义。在调查暗网网站内交易物品和案值等信息时,具有重要线索或证据意义的交易数据包括:卖家ID、交易商品内容、商品价值、交易时间和交易方式等等,然而面对海量的网络信息,人工提取这些交易数据会较为困难。为提升公安机关对暗网违法交易的侦查取证效率,研究并设计暗网交易数据取证系统,实现对暗网违法网站中不法人员发布的交易数据进行文本提取固定,完成哈希值校验并将其结果以可视化形式呈现,不仅便于侦查人员快速提取暗网中违法交易信息、关联分析暗网违法犯罪活动,有利于暗网犯罪侦查的顺利进行,还可为司法部门对案件的定罪量刑提供重要依据。     

互联网跟踪与发现探析

伴随互联网的发展,网络犯罪以及隐藏在网络中的犯罪线索日益增加,跟踪与发现网络空间中的信息,将成为我们在预防犯罪、打击犯罪和取证中的重要手段。因此公安机关应充分利用网络信息,将互联网发现与跟踪实际应用于侦查破案当中,增加信息获取与证据取得的新途径。     

论“互联网+”时代背景下的网络犯罪侦查

"互联网+"时代的到来在促进互联网相关产业迅猛发展的同时,也带来了更高的网络犯罪率和犯罪数额。针对新时期网络犯罪作案手段隐蔽性强、证据获取专业性强、侦破工作合作性强等特点,公安机关应当以提高侦查队伍取证专业水平、构建各部门联动侦查工作机制为重点,并在工作思路上逐步形成由传统的侦破打击为主向事前预防为主、保护创新的思想观念。

信息技术的突飞猛进,将人类社会带进了数字时代,伴随着网络技术的高速发展和日益普及,计算机犯罪出现增长蔓延之势,其危害越来越大,并在犯罪主体、犯罪形式、犯罪方法、犯罪空间和犯罪代价方面表现出不同于传统犯罪的特点。当前,计算机犯罪数字化侦查在发现、取证、鉴定、保全、执法方面存在五个难题,只有进一步加大数字化犯罪发现、取证、鉴定分析、证据保全等技术研发力度和完善相关法律法规制度,才能有效提高数字化侦查取证能力。     

智慧社会背景下网络犯罪组织的打防对策研究
